Purported performance of certain functions by Minister for Health

63. (1) A function (including a function consisting of the power to make a statutory instrument) of the Minister for Children, Equality, Disability, Integration and Youth under the Principal Act performed or purportedly performed by the Minister for Health after the commencement of this section shall be deemed to have been validly performed by the Minister for Children, Equality, Disability, Integration and Youth if, at the time of the performance or purported performance of the function, the Minister for Health believed that the function vested in him or her by virtue of the amendments to the Principal Act, the Act of 2005 or the Act of 2007 effected by this Act.

(2) Where the Minister for Health performs or purports to perform a function of the Minister for Children, Equality, Disability, Integration and Youth under the Principal Act, it shall, in any subsequent proceedings (whether civil or criminal), be presumed, unless the contrary is proved, that at the time of the performance or purported performance of the function the Minister for Health believed that the function vested in him or her by virtue of the amendments to the Principal Act, the Act of 2005 or the Act of 2007 effected by this Act.
