Civil Legal Aid (Refugee Appeals Tribunal) Order 2005

I, MICHAEL MCDOWELL, T.D., Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 27(2)(b) of the Civil Legal Aid Act 1995 (No. 32 of 1995) and the Equality and Law Reform (Transfer of Departmental Administration and Ministerial Functions) Order 1997 ( S.I. No. 297 of 1997 ) (as adapted by the Justice (Alternation of Name of Department and Title of Minister Order 1997 ( S.I. No. 298 of 1997 )) and with the consent of the Minister for Finance hereby order as follows:

1.    (1)  This Order may be cited as the Civil Legal Aid (Refugee Appeals Tribunal Order 2005.

(2)   This Order comes into operation on 1 December, 2005.

2.           The Refugee Appeals Tribunal is prescribed for the purposes of section 27(2)(b) of the Civil Legal Aid Act 1995 (No. 32 of 1995).

3.           The Civil Legal Aid (Refugee Legal Service) Order 1999 ( S.I. No. 74 of 1999 and the Civil Legal Aid (Refugee Legal Service) (No. 2) Order 1999 ( S.I. No. 262 of 1999 ) are revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This Order, which came into effect from the 1st day of December, 2005, replaces the Civil Legal Aid (Refugee Legal Service) Order, 1999 ( S.I. No. 74 of 1999 ) and the Civil Legal Aid (Refugee Legal Service) (No. 2) Order, 1999 ( S.I. No. 262 of 1999 ) which are hereby revoked.

This Order prescribes the Refugee Appeals Tribunal for the purposes of Section 27(2 (b) of the Civil Legal Aid Act, 1995 (No. 32 of 1999) as a body at whose proceedings legal aid may be provided by the Legal Aid Board.
