S.I. No. 262/1999 - Civil Legal Aid (Refugee Legal Service) (No. 2) Order, 1999


I, JOHN O'DONOGHUE, T.D., Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 27 (2)(b) of the Civil Legal Aid Act, 1995 (No. 32 of 1995) (as adapted by the Justice (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 298 of 1997 ), with the consent of the Minister for Finance, hereby order as follows:

1. (1) This Order may be cited as the Civil Legal Aid (Refugee Legal Service) (No. 2) Order, 1999.

(2) This Order shall come into operation on the 4th day of August, 1999.

2. Any tribunal established by the Minister for Justice, Equality and Law Reform for the purpose of determining appeals from determinations authorised in that behalf by that Minister of the Government that an applicant (within the meaning of paragraph 2 of the Dublin Convention (Implementation) Order 1997 ( S.I. No. 360 of 1997 )) should be transferred to a convention country (within the meaning of section 1 (1) of the Refugee Act, 1996 (No. 17 of 1996)) is hereby prescribed for the purposes of section 27 (2)(b) of the Civil Legal Aid Act, 1995 (No. 32 of 1995).

This Order, which came into effect from the 4th August, 1999, prescribes the Appeals Officer as set out in the Dublin Convention (Implementation) Order 1997, as a tribunal for the purposes of section 27 (2)(b) of the Civil Legal Aid Act, 1995 .
