DISTRICT COURT DISTRICTS AND AREAS (AMENDMENT) AND VARIATION OF HOURS ORDER, 1986.

I, ALAN M. DUKES, Minister for Justice, in exercise of the powers conferred on me by section 26 (1) of the Courts of Justice Act, 1953 (No. 32 of 1953), and after consultation with the President of the District Court, hereby order as follows:

1. (1) This Order may be cited as the District Court Districts and Areas (Amendment) and Variation of Hours Order, 1986.

(2) This Order shall come into operation on the 1st day of November, 1986.

2. In this Order—

"the Principal Order" means the District Court (Areas) Order, 1961 ( S.I. No. 5 of 1961 );

"the Order of 1961" means the District Court (Districts) Order, 1961 ( S.I. No. 6 of 1961 ).

3. The district court area of Graiguenamanagh mentioned at reference number 130 in the First Schedule to the Principal Order and at reference number 114 in the Second Schedule to the Principal Order, is hereby abolished.

4. The district court area of Thomastown in hereby varied by the addition, to the District Electoral Divisions mentioned in column (5) at reference number 132 in the First Schedule to, and to the District Electoral Divisions mentioned in column (5) at reference number 116 in the Second Schedule to, the Principal Order (as amended by the District Court Areas and Districts (Amendment) Order, 1983 ( S.I. No. 233 of 1983 )), of the District Electoral Divisions of Freaghana, Graiguenamanagh and Ullard in the county of Kilkenny and the District Electoral Division of Ballymurphy, Coonogue, Glynn, Kyle, Marley, Rathanna and Tinnahinch in the county of Carlow.

5. The Order of 1961 is hereby amended by the deletion in column (3) at reference number 22 in the First Schedule and in column (3) at reference number 22 in the Second Schedule thereto (as amended by the District Court Areas and Districts (Amendment) Order, 1983 ( S.I. No. 233 of 1983 )) of "Graiguenamanagh".

6. The Schedule to the District Court Areas (Amendment) Order, 1970 ( S.I. No. 161 of 1970 ) is hereby amended by the deletion in column (4) at reference number 22 (as amended by the District Court Areas and Districts (Amendment) Order, 1983 ( S.I. No. 233 of 1983 )) of "Graiguenamanagh" and "130".

7. The hours for holding the District Court in the district court area of Kilkenny shall, in lieu of the hours specified in column (4) at reference number 131 in the First Schedule and in column (4) at reference number 115 in the Second Schedule to the Principal Order (as amended by the District Court Areas (Variation of Days and Hours) (No. 3) Order, 1972 ( S.I. No. 236 of 1972 ), and the District Court Areas (Variation of Days and Hours) Order, 1983 ( S.I. No. 234 of 1983 )), be 10.30 a.m.

8. Business transacted in the District Court which is initiated and is not completed before the commencement of this Order shall be continued and completed as if this Order had been in force at the time at which such business was initiated.

EXPLANATORY NOTE.

This Order provides for the abolition of the District Court Area of Graiguenamanagh and the amalgamation of the District Electoral Divisions which comprised it with the District Court Area of Thomastown. The Order also provides for an earlier starting time for the sittings of the District Court in Kilkenny.
