TELEPHONE (AMENDMENT) REGULATIONS, 1977.

I, CONOR CRUISE O'BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 2 of the Telegraph Act, 1885, hereby make, with the consent of the Minister for Finance, the following regulations:

1. (1) These Regulations may be cited as the Telephone (Amendment) Regulations, 1977.

(2) The Telephone Regulations, 1959 to 1975, and these Regulations may be cited together as the Telephone Regulations, 1959 to 1977.

2. These Regulations shall come into operation on the 1st day of April, 1977.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. In these Regulations—

"the Regulations of 1971" means the Telephone (Amendment) Regulations, 1971 ( S.I. No. 63 of 1971 );

"the Regulations of 1974" means the Telephone (Amendment) Regulations, 1974 ( S.I. No. 363 of 1974 );

"the Regulations of 1975" means the Telephone (Amendment) Regulations, 1975 ( S.I. No. 313 of 1975 ).

5. (1) The Telephone Regulations, 1959 ( S.I. No. 118 of 1959 ) shall be amended by:

(a) the substitution of "4p" for "3.2p" in Regulation 5 (2) (a) (inserted therein by Regulation 5 (1) (b) of the Regulations of 1975);

(b) the substitution of "4.75p" for "3.75p" in Regulation 5 (2) (b) (inserted therein by Regulation 5 (1) (b) of the Regulations of 1974);

(c) the substitution of "5p" for "4p" in Regulation 5 (3) (a) (inserted therein by Regulation 5 (1) (c) of the Regulations of 1974);

(d) the substitution of "5p" for "4p" in Regulation 5 (3) (b) (inserted therein by Regulation 5 (1) (d) of the Regulations of 1974);

(e) the substitution of "19p" for "15p" in Regulation 9 (1) (inserted therein by Regulation 5 (1) (c) of the Regulations of 1975);

(f) the substitution of "19p" for "15p" in Regulation 12 (inserted therein by Regulation 5 (1) (d) of the Regulations of 1975);

(g) the substitution of "12p" for "10p" in Regulation 17A (inserted by Regulation 5 (e) of the Telephone (Amendment) Regulations, 1968 ( S.I. No. 274 of 1968 )), as amended by Regulation 5 (1) (e) of the Regulations of 1975;

(h) the substitution of "19p" for "15p" in Regulation 17B (2) (inserted by Regulation 5 (1) (f) of the Regulations of 1975);

(i) the substitution of "30p" for "25p" in Regulation 18 (3) (inserted therein by Regulation 5 (p) of the Regulations of 1971);

(j) the substitution of "£2.50" for "£2.00" in Regulation 44 inserted therein by Regulation 5 (1) (g) of the Regulations of 1975;

(k) the substitution of the following for the Second Schedule (inserted by Regulation 5 (1) (h) of the Regulations of 1975):

"SECOND SCHEDULE

Charges for Subscriber Dialled Trunk Calls.

In respect of each period or part of a period of time specified in the Table to this Schedule which is appropriate to the call and during which the call continues—

(a) the sum of 4p shall be charged to a subscriber without a coinbox, and

(b) the sum of 6p shall be paid by a caller from a call office for the first period of time, 5p for the second period of time and 5p for the third period of time, and if the length of the call exceeds those periods combined, the aforementioned cycle of payment shall apply in relation to such further time as the call continues.

(2) Regulations 5 (2), 5 (3), 9 (1), 12, 17A, 17B (2), 18 (3), and 44 of the Telephone Regulations, 1959, as amended by paragraph (1) of this Regulation, are set out in paragraphs 1, 2, 3, 4, 5, 6, 7 and 8. respectively, of the Table to this Regulation.

Regulation 5 (2).

1. (2) In respect of every call made by a subscriber to a telephone in the same telephone group or to a telephone in another telephone group which is regarded as adjacent to the telephone group of the subscriber making the call there shall be charged to the subscriber and paid by him—

(a) if he rents an exchange line without a coin-box—the sum of 4p,

(b) if he rents a coin-box exchange line—the sum of 4.75p.

Regulation 5 (3).

2. (3) (a) In respect of every call made by a caller from a call office to a telephone in the same telephone group or to a telephone in another telephone group which is regarded as adjacent to the telephone group of the call office from which the call is being made there shall be charged the sum of 5p.

(b) In respect of every call made from a coin-box exchange line to a telephone in the same telephone group or to a telephone in another telephone group which is regarded as adjacent to the telephone group of the coin-box exchange line from which the call is being made there shall be placed in the coin-box the sum of 5p.

Regulation 9 (1).

3. (1) There shall be charged and paid for a personal call (in addition to such other charge or charges as may be payable under these Regulations in respect of the call) a personal charge of 19p.

Regulation 12.

4. 12. The charge in respect of an alarm clock call shall be 19p.

Regulation 17A.

5. 17A. The Minister may supply particulars of the duration of or charge for a completed trunk call (excluding a subscriber dialled trunk call), or of both such duration and charge, on the request of a subscriber and there shall be charged to the subscriber and paid by him in respect of each call of which such particulars are supplied the sum of 12p (in addition to such other charge or charges as may be payable under these Regulations in respect of the call).

Regulation 17B (2).

6. (2) In case a reverse charge call is made to a telephone in the State from a telephone in the State, Northern Ireland, Great Britain, the Isle of Man, or the Channel Islands, there shall be charged to and payable by the subscriber who is the subscriber in respect of the called telephone the sum of 19p in addition to such other charge or charges (save any personal charge in case the call is made from a coinbox exchange line) as may be payable under these Regulations in respect of the call as if the call were made from the called telephone.

Regulation 18 (3).

7. (3) If, after acceptance of an agreement by the Minister, expense is incurred by the Minister in providing an exchange line or private telephone circuit and an applicant should notify his desire to withdraw from the agreement before service on the said exchange line or circuit has been given or shall refuse or neglect to afford the facilities necessary and reasonable for the completion of the work, the subscriber shall pay to the Minister on demand:—

(a) a sum equivalent to the rental for the full term provided under the agreement, or, at the option of the Minister—

(b) the amount of the costs and expenditure incurred by the Minister in and about all works undertaken for the provision of the said exchange line or circuit up to the date of the said notice of withdrawal or refusal or neglect to afford facilities as aforesaid, together with the costs and expenses of the recovery and removal of any works so erected.

In addition to the said amount as aforesaid the subscriber shall also pay to the Minister, on demand, the sum of 30p for cancellation of the agreement.

Regulation 44.

8. 44. If any subscription or any fee, charge, expense or damages payable by the subscriber under the agreement or under the other provisions of these Regulations is in arrear for fourteen days, excluding Sundays and public holidays, after the relative account has been rendered, or the subscriber has failed to offer such security as may be required by the Minister in accordance with Regulation 31, the Minister may, without notice, and without prejudice to the terms of the agreement or to the provisions of these Regulations, wholly or in part suspend services on the exchange line or disconnect the exchange line from the exchange and may make in respect of any restoration of service after suspension or disconnection under the terms of this Regulation a charge of £2.50 to be payable on demand.

EXPLANATORY NOTE.

The purpose of these Regulations is to amend the Telephone Regulations 1959 to 1975 to provide for the following increases in charges:

Local Calls
Charge to non coin-box subscriber	from 3.2p to 4p
Charge to a caller from a coin-box or call office	from 4p to 5p
Charge to renter of coin-box line	from 3.75p to 4.75p
Trunk Calls
Calls from non coin-box line	(i) from 3.2p to 4p for each specified period of time on subscriber dialled trunk calls.
	(ii) 25% on internal and Cross Channel calls obtained through an operator.
Calls from a call office or coin-box line
	(i) in charges for dialled calls from call offices—from 5p for the first period of time, 4p for the second period of time and 4p for the third period of time to 6p for the first period of time, 5p for the second period of time and 5p for the third period of time.
	(ii) in charges for calls obtained through operator —internal day rates from 13p, 26p and 39p to 16p, 32p and 50p, and night rates from 9p, 18p and 26p to 11p, 22p and 34p respectively; Cross Channel day and night rates from 78p and 52p to 96p and 66p respectively—all per 3 minutes.
