TELEPHONE (AMENDMENT) REGULATIONS, 1974.

I, CONOR CRUISE- O'BRIEN, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by Section 2 of the Telegraph Act, 1885, hereby make, with the consent of the Minister for Finance, the following regulations:

1. (1) These Regulations may be cited as the Telephone (Amendment) Regulations, 1974.

(2) The Telephone Regulations, 1959 to 1973, and these Regulations may be cited together as the Telephone Regulations, 1959 to 1974.

2. These Regulations shall come into operation on the 1st day of January, 1975.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. In these Regulations—

"the Regulations of 1971" means the Telephone (Amendment) Regulations, 1971 ( S.I. No. 63 of 1971 );

"the Regulations of 1973" means the Telephone (Amendment) Regulations, 1973 ( S.I. No. 193 of 1973 ).

5. (1) The Telephone Regulations, 1959 ( S.I. No. 118 of 1959 ), shall be amended by:

( a ) the substitution of "2.36p" for "2p" in Regulation 5 (2) (a) (inserted therein by Regulation 5 (1) (a) of the Regulations of 1973);

( b ) the substitution of "3.75p" for "2.75p" in Regulation 5 (2) (b)) (inserted therein by Regulation 5 (1) (b) of the Regulations of 1973);

( c ) the substitution of "4p" for "3p" in Regulation 5 (3) (a) (inserted therein by Regulation 5 (1) (c) of the Regulations of 1973);

( d ) the substitution of "4p" for "3p" in Regulation 5 (3) (b) (inserted therein by Regulation 5 (1) (d) of the Regulations of 1973);

( e ) the substitution of—

(A) "56 kilometres" for "thirty-five miles", and

(B) "80 kilometres" for "fifty miles",

in each place where they occur in paragraphs (4) and (5), respectively, of Regulation 6 (the said paragraphs having been inserted by Regulation 5 (i) of the Regulations of 1971);

( f ) the substitution of "12p" for "10p" in Regulation 9 (1) (inserted therein by Regulation 5 (k) of the Regulations of 1971);

( g ) the substitution of the following for Regulation 12: "The charge in respect of an alarm clock call shall be 10p";

( h ) the substitution of "7p" for "5p" in Regulation 17A inserted by Regulation 5 (e) of the Telephone (Amendment) Regulations, 1968 ( S.I. No. 274 of 1968 ), and amended by Regulation 5 (o) of the Regulations of 1971);

( i ) in the Second Schedule (inserted by Regulation 5 (1) (e) of the Regulations of 1973)—

(A) the substitution of "2.36p" for "2p" in paragraph (a), and

(B) the deletion of all the words after "call office" in paragraph (b);

( j ) the substitution of the following for the Third Schedule (inserted by Regulation 5 (t) of the Regulations of 1971):

(2) In accordance with the provisions of sub-paragraphs (a) to ( f ) and (h) and (i) of paragraph (1) of this regulation, the provisions of the Principal Regulations specified in the Table to this regulation shall have effect as set out therein.

TABLE.

Paragraphs (2) and (3) of Regulation 5.

(2) In respect of every call made by a subscriber to a telephone in the same telephone group or to a telephone in another telephone group which is regarded as adjacent to the telephone group of the subscriber making the call there shall be charged to the subscriber and paid by him—

( a ) if he rents an exchange line without a coinbox—the sum of 2.36p

( b ) if he rents a coinbox exchange line—the sum of 3.75p.

(3) ( a ) In respect of every call made by a caller from a call office to a telephone in the same telephone group or to a telephone in another telephone group which is regarded as adjacent to the telephone group of the call office from which the call is being made there shall be charged the sum of 4p,

( b ) In respect of every call made from a coinbox exchange line to a telephone in the same telephone group or to a telephone in another telephone group which is regarded as adjacent to the telephone group of the coinbox exchange line from which the call is being made there shall be placed in the coinbox the sum of 4p.

Paragraphs (4) and (5) of Regulation 6.

(4) In respect of every trunk call (excluding subscriber dialled trunk calls) made at or after 8 a.m. and before 6 p.m. by a subscriber who rents an exchange line without a coin box there shall be charged to the subscriber and paid by him—

( a ) where the distance between the group centres of the exchanges connected for the purpose of the call does not exceed 56 kilometres for each period of three minutes or part of three minutes during which the call continues the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

( b ) where the distance between the group centres of the exchanges connected for the purpose of the call exceeds 56 kilometres—

(i) if the duration of the call does not exceed three minutes, the charges stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

(ii) if the duration of the call exceeds three minutes, the charge stated in the said Fourth Schedule which is appropriate to the call together with, for each minute or part of a minute in excess of three minutes during which the call continues, a further charge equal to one-third of the said charge stated in the Fourth Schedule which is appropriate to the call.

(5) In respect of every trunk call (excluding subscriber dialled trunk calls) made at or after 6 p.m. and before 8 a.m. by a subscriber who rents an exchange line without a coinbox there shall be charged to the subscriber and paid by him—

( a ) where the distance between the group centres of the exchanges connected for the purpose of the call does not exceed 80 kilometres for each period of three minutes or part of three minutes during which the call continues the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

( b ) where the distance between the group centres of the exchanges connected for the purpose of the call exceeds 80 kilometres—

(i) if the duration of the call does not exceed three minutes, the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call, or

(ii) if the duration of the call exceeds three minutes, the charge stated in the Fourth Schedule to these Regulations which is appropriate to the call together with, for each minute or part of a minute in excess of three minutes during which the call continues, a further charge equal to one-third of the said charge stated in the said Fourth Schedule which is appropriate to the call.

Regulation (9 (1).

9 (1) There shall be charged and paid for a personal call (in addition to such other charge or charges as may be payable under these Regulations in respect of the call) a personal charge of 12p.

Regulation 17A.

17A. The Minister may supply particulars of the duration of or charge for a completed trunk call (excluding a subscriber dialed trunk call), or of both such duration and charge, on the request of a subscriber and there shall be charged to the subscriber and paid by him in respect of each call of which such particulars are supplied the sum of 7p (in addition to such other charge or charges as may be payable under these Regulations in respect of the call).

SECOND SCHEDULE.

Charges for Subscriber Dialled Trunk Calls.

In respect of each period or part of a period of time specified in the Table to this Schedule which is appropriate to the call and during which the call continues—

( a ) the sum of 2.36p shall be charged to a subscriber without a coinbox, and

( b ) the sum of 3p shall be paid by a caller from a call office.

EXPLANATORY NOTE.

The purpose of these regulations is to amend the Telephone Regulations 1959 to 1973 to provide for (a) the expression of distances in metric units and (b) the following increases in charges:

Local calls

Charge to non-coinbox subscriber
