THE SWINE FEVER (CONTROLLED AREA) ORDER, 1957.

I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by the Agriculture Acts, 1931 to 1955, and sections 22 and 49 of the Diseases of Animals Act, 1894 hereby order as follows :-

1. This Order may be cited as the Swine Fever (Controlled Area) Order, 1957.

2. This Order shall come into operation on the 12th day of December, 1957.

3. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

4. In this Order—

" controlled area " means the area comprising the county borough of Dublin and that part of the administrative county of Dublin comprising the former rural district of Rathdown No. 1 (including the borough of Dún Laoghaire) ;

" inspector " means an Inspector of the Minister ;

" the Minister " means the Minister for Agriculture ;

" permit " means a permit granted under Article 6 of this Order.

5. The movement of swine into, out of or within the controlled area, except under and in accordance with a permit or in compliance with a direction given by a member of the Garda Siochána under Article 8 of this Order, is prohibited.

6. An inspector or a member of the Garda Siochána may, in his absolute discretion, grant or refuse to grant to any person a permit in writing allowing the movement of pigs into, out of or within the controlled area.

7.—(1) A permit shall accompany the movement in respect of which it is issued and the person who is in charge of that movement shall produce it to an inspector or a member of the Garda Siochána on demand.

(2) Immediately after the completion of the movement in respect of which a permit is issued, the person who is in charge of that movement shall deliver it—

(a) in case the movement was to a place of embarkation, to an inspector at that place,

(b) in case the movement was for slaughter, to the person in charge of the place of slaughter,

(c) in case the movement was to the Dublin Corporation Market to a member of the Garda Siochána or an inspector at the Market, and

(d) in case the movement was to any other premises, to the Department of Agriculture.

8.—(1) Where pigs are being moved in contravention of a provision of this Order, a member of the Garda Siochána may direct the owner or person in charge of the pigs to move them to any place or premises specified by the member.

(2) A direction under paragraph (1) of this Article shall be complied with by the person to whom it is given.

9. The Swine Fever (Restriction of Movement of Pigs) Order, 1957 ( S.I. No. 128 of 1957 ), the Swine Fever (Restriction of Movement of Pigs) Order, 1957 (Amendment) Order, 1957 ( S.I. No. 166 of 1957 ), and the Swine Fever (Restriction of Movement of Pigs) Order, 1957 (Amendment) (No. 2) Order, 1957 ( S.I. No. 189 of 1957 ), are hereby revoked.

Explanatory Note.

This Order prohibits the movement, except under permit, of pigs into, out of and within the Dublin area and removes the restrictions on the movement of pigs outside that area.
