SWINE FEVER (RESTRICTION OF MOVEMENT OF PIGS) ORDER, 1957.

I, SEÁN MOYLAN, Minister for Agriculture, in exercise of the powers conferred on me by the Agriculture Acts, 1931 to 1955, and the Diseases of Animals Acts, 1894 to 1954, hereby order as follows :—

1. This Order may be cited as the Swine Fever (Restriction of Movement of Pigs) Order, 1957.

2. This Order shall come into operation on the 25th day of June, 1957.

3. In this Order—

" inspector " means an Inspector of the Minister for Agriculture ; " public sale " includes a market or fair and any sale either by auction or otherwise which is open to the public whether held in a public place or not and whether or not pigs of different owners are exposed thereat ;

" transit permit " means a permit issued by an Inspector or a member of the Gárda Síochána under Article 6 of this Order.

4. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

5. The movement of pigs is prohibited, provided that the prohibition shall not apply to—

(a) the movement of fat pigs for slaughter under and in accordance with a transit permit,

(b) the movement to a public sale under and in accordance with a transit permit of fat pigs intended to be sold at that public sale for slaughter,

(c) the movement of pigs in compliance with a direction given by a member of the Garda Síochána under Article 7 of this Order,

(d) the movement of pigs under and in accordance with a transit permit to a place of embarkation for exportation by sea, or

(e) the temporary direct movement for mating purposes of sows to and from a place where a boar licensed under the Live Stock Breeding Act, 1925 (No. 3 of 1925), is kept.

6.—(1) Subject to paragraph (2) of this Article, a transit permit shall be issued by an inspector or a member of the Garda Síochána.

(2) The issue of a transit permit shall be in the absolute discretion of the inspector or member.

(3) A transit permit shall accompany the movement in respect of which it is issued and the person who is in charge of that movement shall produce it to an inspector or a member of the Garda Síochána on demand.

(4) Immediately after the completion of the movement in respect of which a transit permit is issued, the person who is in charge of that movement shall deliver it—

(a) in case the movement was to a place of embarkation, to an inspector at that place,

(b) in case the movement was for slaughter, to the person in charge of the place of slaughter, and

(c) in case the movement was to a public sale, to a member of the Garda Síochána present at the sale or the nearest Garda Síochána barracks.

7.—(1) Where pigs—

(a) are being moved in contravention of a provision of this Order, or

(b) are at a public sale, having been offered for sale for slaughter, and are unsold,

a member of the Garda Sáochána may direct the owner or person in charge of the pigs to move them to any place or premises specified by the member.

(2) A direction under paragraph (1) of this Article shall be complied with by the person to whom it is given.

8. The Swine Fever Infected Area Order, 1956 ( S.I. No. 223 of 1956 ), the Swine Fever (Dublin), Order, 1956 ( S.I. No. 242 of 1956 ), the Swine Fever Infected Area Order, 1956 (Amendment) Order, 1956 ( S.I. No. 276 of 1956 ) and the Swine Fever Infected Area Order, 1956 (Amendment) Order, 1957 ( S.I. No. 107 of 1957 ) are hereby revoked.

Explanatory Note.

The effect of the Order is to prohibit the movement of pigs except the temporary movement of sows for mating and the movement under permit of fat pigs for slaughter and of pigs for export by sea.
