TELEGRAPH (INLAND WRITTEN TELEGRAM) AMENDMENT (NO. 6) WARRANT, 1955.

I, MICHAEL KEYES, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 2 of the Telegraph Act, 1885, and of every and any other power me in this behalf enabling, and with the consent of the Minister for Finance, hereby make the regulations contained in the following Warrant :

1.—(1) This Warrant may be cited as the Telegraph (Inland Written Telegram) Amendment (No. 6) Warrant, 1955.

(2) This Warrant shall come into operation on the 1st day of August, 1955.

2.—(1) In this Warrant—

" the Minister " means the Minister for Posts and Telegraphs ;

" the Principal Warrant " means the Telegraph (Inland Written Telegram) Regulations, 1920 ;

" overnight telegram " means a telegram accepted for transmission overnight at a reduced rate on condition that delivery will be made by the next convenient postal delivery thereafter or, if the Minister thinks fit, by telephone or by any other means ;

" written telegram " includes a telegram tendered by telephone or other electrical or mechanical apparatus for treatment as a written telegram.

(2) The Principal Warrant, as amended, and this Warrant shall be construed as one.

3. The Principal Warrant, as amended, and this Warrant shall apply to written telegrams originating in and addressed to places within the State and, subject to Regulation 5, paragraph (1) sub-paragraph (b) of Regulation 7, paragraph (2) of Regulation 8, Regulation 10 and Regulation 13 of this Warrant, to written telegrams between places within the Irish Telegraph Administration and places within the British Telegraph Administration so far as relates to the transmission, delivery and treatment of the telegrams under the authority of the Minister.

4. Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of a telegram, other than an overnight telegram, within the State :

(a) if the length of the telegram does not exceed twelve words 2s. 6d. ;

(b) if the length of the telegram exceeds twelve words, 2s. 6d. for the first twelve words and 2d. for each additional word.

5. Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of a telegram addressed to a place within the British Telegraph Administration :

(a) if the length of the telegram does not exceed twelve words, 3s. 6d. ;

(b) if the length of the telegram exceeds twelve words, 3s. 6d. for the first twelve words and 3d. for each additional word.

6. In respect of a telegram tendered on Sunday, Good Friday or a public holiday, there shall be charged and paid 1s. in addition to the amount payable under Regulation 4 or Regulation 5 (as may be appropriate) of this Warrant.

7.—(1) Subject to the conditions specified in paragraph (2) of this Regulation being satisfied, there shall be charged and paid for a telegram addressed to a newspaper, news agency, newsroom, club or exchange room and containing matter intended for publication as news (excluding (i) letters to the editor of a newspaper and (ii) advertisements, notices and articles which are not normally published without charge)—

(a) for a telegram within the State, for each 60 words or part thereof, 2s., 6d. ;

(b) for a telegram addressed to a place within the British Telegraph Administration, for each 60 words or part thereof, 3s. 6d.

(2) The conditions referred to in paragraph (1) of this Regulation are :

(a) that the message is not in a foreign language and does not contain cypher,

(b) that the address is the name only of the newspaper, news agency, newsroom, club or exchange room and its location,

(c) that the newspaper, news agency, newsroom, club or exchange room is registered as such at the General Post Office in Dublin or the General Post Office in London (as may be appropriate).

(3) Regulation 1 and paragraph (1) of Regulation 9 of the Principal Warrant shall not apply to a telegram transmitted under this Regulation.

(4) The charge for repetition of any portion of the message contained in a telegram transmitted under this Regulation shall be half the charge appropriate in accordance with subparagraph (a) or subparagraph (b) (as may be appropriate) of paragraph (1) of this Regulation, but where the repetition discloses an error in transmission, the charge for repetition shall be waived.

(5) Regulation 25 of the Principal Warrant shall apply to the counting of a telegram transmitted under this Regulation, but with the following exceptions :

(a) figures and groups of letters whether combined or not shall be counted at the rate of one word per figure or letter and charged accordingly,

(b) each underline, parenthesis or set of inverted commas shall be counted and charged for as two words,

(c) the symbol % meaning per cent. shall be counted and charged for as 3 words.

(6) (a) A telegram transmitted under this Regulation may at the request of the sender be delivered at several addresses within the limit of free delivery of the terminal telegraph office. In such case there shall be charged and paid for the delivery of the telegram at each address after the first the sum of 9d. for each 60 words or part thereof. Subject to the foregoing provisions of this sub-paragraph, each transmission of the telegram to a separate address shall be charged for as the transmission of a separate telegram.

(b) Regulation 20 of the Principal Warrant (being the regulation set out in Regulation 6 of the Telegraph (Inland Written Telegram) Amendment (No. 1) Warrant, 1928, as amended by this Warrant) shall not apply to a telegram transmitted under this Regulation.

8.—(1) In paragraph (1) of Regulation 7 of the Principal Warrant " 6d." shall be substituted for " 3d. " (the latter sum being that inserted in that paragraph by the Telegraph (Inland Written Telegram) Amendment (No. 3) Warrant, 1936, which is revoked by this Warrant).

(2) The charges for the delivery by special messenger beyond the limit of free delivery of a telegram addressed to a place within the British Telegraph Administration shall not be prepaid by the sender.

9.—(1) Subject to the provisions of this Warrant, there shall be charged and paid for the transmission of an overnight telegram :

(a) if the length of the telegram does not exceed twelve words, 1s. 6d. ;

(b) if the length of the telegram exceeds twelve words, 1s. 6d. for the first twelve words and 3d. for each additional word.

(2) An overnight telegram shall be tendered only on a weekday (not being Good Friday or a public holiday) between the hours 9 a.m. and 10 p.m.

(3) The address of an overnight telegram shall be a full postal address.

(4) A Telegraph Money Order shall not be sent as an overnight telegram.

(5) An overnight telegram shall not be accepted for transmission to a place within the British Telegraph Administration.

(6) Regulations 5, 6, 7, 8, 22 and 34 of the Principal Warrant, paragraph (2) of Regulation 9 of that Warrant and Regulation 6 of the Telegraph (Inland Written Telegram) Amendment (No. 1) Warrant, 1928, and any amendments thereto, shall not apply to an overnight telegram.

10. The sender of a telegram may pay for the transmission of a reply thereto at the appropriate rate or rates, but the sum so paid shall not—

(a) in the case of a telegram within the State, be less than 1s. 6d. or exceed 10s. 0d., and

(b) in the case of a telegram to a place within the British Telegraph Administration, be less than 3s. 6d. or exceed 12s. 0d.

11. In Regulation 6 of the Telegraph (Inland Written Telegram) Amendment (No. 1) Warrant, 1928 for " 4d. " (after " the sum of "), " 2s. 1d. " " 4d." (after " 5 copies at "), " 1s. 8d." and " 3s. 9d." (inserted by Article 4 (revoked by this Warrant) of the Telegraph (Inland Written Telegram) Amendment (No. 4) Warrant, 1937) there shall be substituted respectively " 9d.", " 4s. 2d." " 9d.", " 3s. 9d." and " 7s. 11d.".

12. In Regulation 27 of the Principal Warrant " ninepence "shall be substituted for " fourpence."

13. In paragraph (2) of Regulation 32 of the Principal Warrant the reference to a fixed charge of one shilling (restored by Regulation 5 (revoked by this Warrant), of the Telegraph (Inland Written Telegram) Amendment (No. 4) Warrant, 1937) shall be construed as a reference to a fixed charge of 2s. 6d. in respect of a telegram within the State or of 3s. 6d. in respect of a telegram to a place within the British Telegraph Administration.

14. In subparagraph (c) of paragraph (2) of Regulation 33 of the Principal Warrant " £4 " shall be substituted for " £2 ".

15.—(1) In subparagraph (a) of paragraph (2) of Regulation 34 of the Principal Warrant for " Is." " 2s. 6d." " sum of one guinea " and " one guinea per annum " there shall be substituted respectively " 2s. 6d." " 5s.", " sum of two guineas " and " two guineas per annum ".

(2) In subparagraph (b) of paragraph (2) of Regulation 34 of the Principal Warrant " 10s." shall be substituted for " 5s.".

16. There shall be charged and paid for a telegram applying for a withdrawal from the Post Office Savings Bank, Dublin, 2s. 6d., and for the reply telegram authorising the withdrawal from the Savings Bank, 2s. 6d.

17.—(1) The following are hereby revoked :

(a) Regulation 39 of the Principal Warrant,

(b) Regulations 2, 4 and 9 of the Telegraph (Inland Written Telegram) Amendment (No. 1) Warrant, 1928 ( S. R. & O. No. 45 of 1928 ),

(c) the Telegraph (Inland Written Telegram) Amendment (No. 3) Warrant, 1936 ( S. R. & O. No. 204 of 1936 ),

(d) the Telegraph (Inland Written Telegram) Amendment (No. 4) Warrant, 1937 ( S. R. & O. No. 133 of 1937 ),

(e) the Telegraph (Inland Written Telegram) Amendment (No. 5) Warrant, 1938 ( S. R. & O. No. 327 of 1938 ),

(f) the Telegraph (Press Telegrams) Regulations, 1879,

(g) the Telegraph (Press Telegrams) Amendment (No. 1) Regulations, 1919,

(h) the Telegraph (Press Telegrams) Amendment (No. 2) Regulations, 1919.

(2) The revocations provided for in this Warrant shall not except as specifically provided in this Warrant revive anything not in force or existing at the time at which the revocation takes effect or affect anything done or suffered before this Warrant came into operation.
