CERVICALCHECK TRIBUNAL (AMENDMENT) ACT 2021


An Act to amend the CervicalCheck Tribunal Act 2019 to extend the period for the making of claims for compensation to the CervicalCheck Tribunal; to provide that the Minister may by order extend that period; and to provide for related matters.

Be it enacted by the Oireachtas as follows:

Amendment of section 12 of CervicalCheck Tribunal Act 2019

1. Section 12 of the CervicalCheck Tribunal Act 2019 is amended—

(a) in subsection (1) —

(i) by the substitution, in paragraph (a), of the following subparagraph for subparagraph (ii):

“(ii) on or before the 26th day of January 2022 or such later date, being a date not later than the 26th day of July 2022, as the Minister may by order specify under subsection (3A),”,

and

(ii) by the substitution of the following paragraph for paragraph (b):

“(b) in any other case, on or before the 26th day of January 2022 or such later date, being a date not later than the 26th day of July 2022, as the Minister may by order specify under subsection (3A).”,

and

(b) by the insertion of the following subsection after subsection (3):

“(3A) The Minister may—

(a) if and only if he or she is satisfied, having regard to the purposes of this Act, that there is good and sufficient reason for so doing, and

(b) after consultation with—

(i) the Minister for Public Expenditure and Reform,

(ii) any other Minister of the Government as the Minister considers appropriate having regard to the functions of that other Minister of the Government, and

(iii) the Tribunal,

by order specify a later date for the purposes of paragraphs (a)(ii) and (b) of subsection (1).”.

Short title

2. This Act may be cited as the CervicalCheck Tribunal (Amendment) Act 2021.
