COMMUNICATIONS REGULATION (POSTAL SERVICES) (AMENDMENT) ACT 2017


An Act to provide for the repeal of section 30 of the Communications Regulation (Postal Services) Act 2011 ; to amend the Communications Regulation Act 2002 to confer additional functions on the Commission for Communications Regulation relating to the repeal of section 30; and to provide for related matters.

Be it enacted by the Oireachtas as follows:

Repeal of section 30 of Communications Regulation (Postal Services) Act 2011

1. Section 30 of the Communications Regulation (Postal Services) Act 2011 is repealed and accordingly any price cap decision (within the meaning of the said section 30) made under that section by the Commission for Communications Regulation ceases to have effect.

Amendment of section 10 of Communications Regulation Act 2002

2. Section 10 of the Communications Regulation Act 2002 is amended—

(a) in subsection (1) by the insertion of the following paragraph after paragraph (ba):

“(bb) to undertake a review of any consequences, including for terminal dues, of the repeal, under section 1 of the Communications Regulation (Postal Services) (Amendment) Act 2017, of section 30 of the Communications Regulation (Postal Services) Act 2011 which review shall commence immediately following the expiration of 2 years after the coming into operation of the Communications Regulation (Postal Services) (Amendment) Act 2017 and to prepare and furnish a report to the Minister of the findings of the Commission resulting from the review not later than 6 months after the commencement of the review,”,

and

(b) by the insertion of the following subsections after subsection (4):

“(5) (a) In carrying out the review under subsection (1)(bb) the Commission may consult with such persons as it considers appropriate. The Commission shall complete this consultation within a period of 42 days.

(b) The Minister shall cause a copy of the report prepared under subsection (1)(bb) to be laid before each House of the Oireachtas as soon as practicable after it is furnished to him or her by the Commission.

(6) In subsection (1)(bb) ‘terminal dues’ has the same meaning as it has in Part 2 of the Communications Regulation (Postal Services) Act 2011 .”.

Short title, commencement, collective citation and construction

3. (1) This Act may be cited as the Communications Regulation (Postal Services) (Amendment) Act 2017.

(2) This Act shall come into operation on such day as the Minister for Communications, Climate Action and Environment may by order appoint.

(3) The Communications Regulation Acts 2002 to 2011 and this Act may be cited together as the Communications Regulation Acts 2002 to 2017 and shall be construed together as one.
