Offences and general penalty for contravention or failure to comply with provision of Act.

65.—(1) A person who contravenes or fails to comply with a term of a licence or a condition subject to which it is issued shall be guilty of an offence.

(2) A person who is guilty of an offence under subsection (1) or any other provision of this Act shall, where no other penalty is prescribed by this Act for the offence, be liable—

(a) on summary conviction, to a fine not exceeding £1,500, or to imprisonment for a term not exceeding 12 months, or to both, or

(b) on conviction on indictment, to a fine not exceeding £100,000, or to imprisonment for a term not exceeding two years, or to both.

(3) Notwithstanding section 309 of the Principal Act, a summary offence under the Fisheries (Amendment) Act, 1997, shall be prosecuted only—

(a) by the Minister; or

(b) at the suit of the Director of Public Prosecutions.
