HEALTH (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1958.

The Government, in exercise of the powers conferred on them by subsection (1) of section 6 of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), hereby order as follows :

1. (1) This Order may be cited as the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1958.

(2) This Order shall come into operation on the 30th day of September, 1958.

2. In this Order—

" functions " includes powers and duties ;

" operative date " means the date on which this Order comes into operation.

3. The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 4 of this Order are hereby transferred to the Department of Health.

4. The functions of the Minister for Local Government under section 86 of the Public Assistance Act, 1939 (No. 27 of 1939), as adapted by the Local Government and Public Health (Alteration of Name of Department and Title of Minister) Order, 1947 ( S. R. & O. No. 16 of 1947 ), are hereby transferred to the Minister for Health, and references in that section, as so adapted, to the Minister for Local Government shall, on and after the operative date, be construed as references to the Minister for Health.

EXPLANATORY NOTE.

This Order transfers from the Minister for Local Government to the Minister for Health the functions under Section 86 of the Public Assistance Act, 1939 , relating to the closing of county infirmaries and county fever hospitals.
