I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Commission Regulation (EU) 2015/1190 of 20 July 20151 , Commission Regulation (EU) 2016/1120 of 11 July 20162 , Commission Regulation (EU) 2016/1121 of 11 July 20163 , Commission Regulation (EU) 2016/1143 of 13 July 20164 , Commission Regulation (EU) 2016/1198 of 22 July 20165 , Commission Regulation (EU) 2016/314 of 4 March 20166 and Commission Regulation (EU) 2017/237 of 10 February 20177 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Cosmetic Products) (Amendment) Regulations 2017.

(2) The Principal Regulations, the European Union (Cosmetic Products) (Amendment) Regulations 2015 ( S.I. No. 512 of 2015 ), the Regulations of 2016 and these Regulations may be cited together as the European Union (Cosmetic Products) Regulations 2013 to 2017 and shall be construed together as one.

2. In these Regulations—

“Principal Regulations” means the European Union (Cosmetic Products) Regulations 2013 ( S.I. No. 440 of 2013 );

“Regulations of 2016” means the European Union (Cosmetic Products) (Amendment) Regulations 2016 ( S.I. No. 317 of 2016 ).

3. Regulation 2(1) (as amended by Regulation 3 of the Regulations of 2016) of the Principal Regulations is amended by substituting for the definition of “EU Regulation” the following:

“‘EU Regulation’ means Regulation (EC) No. 1223/2009 of the European Parliament and of the Council of 30 November 20098 , as amended by Commission Regulation (EU) No. 344/2013 of 4 April 201319, Commission Regulation (EU) No. 483/2013 of 24 May 20139 , Commission Regulation (EU) No. 658/2013 of 10 July 201310 , Commission Regulation (EU) No. 1197/2013 of 25 November 201311 , Commission Regulation (EU) No. 358/2014 of 9 April 201412 , Commission Regulation (EU) No. 866/2014 of 8 August 201413 , Commission Regulation (EU) No. 1003/2014 of 18 September 201414 , Commission Regulation (EU) No. 1004/2014 of 18 September 201415 , Commission Regulation (EU) 2015/1190 of 20 July 20151, Commission Regulation (EU) 2015/1298 of 28 July 201516 , Commission Regulation (EU) 2016/621 of 21 April 201617 , Commission Regulation (EU) 2016/622 of 21 April 201618 , Commission Regulation (EU) 2016/1120 of 11 July 20162, Commission Regulation (EU) 2016/1121 of 11 July 20163, Commission Regulation (EU) 2016/1143 of 13 July 20164, Commission Regulation (EU) 2016/1198 of 22 July 20165, Commission Regulation (EU) 2016/314 of 4 March 20166 and Commission Regulation (EU) 2017/237 of 10 February 20177;”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the European Union (Cosmetic Products) Regulations 2013 to give effect to a number of Commission Regulations. These Regulations have the effect of—

— accounting for amendments pertaining to the restrictions in relation to permanent hair dyes (Commission Regulation (EU) 2015/1190 of 20 July 2015),

— accounting for amendments pertaining to the restrictions in relation to carbon black (Commission Regulation (EU) 2016/1120 of 11 July 2016),

— accounting for amendments pertaining to the restrictions in relation to Ethyl Lauroyl Arginate HCl (Commission Regulation (EU) 2016/1121 of 11 July 2016),

— accounting for amendments pertaining to the restrictions in relation to Titanium Dioxide (Commission Regulation (EU) 2016/1143 of 13 July 2016),

— accounting for amendments pertaining to the restrictions in relation to Methylisothiazolinone (Commission Regulation (EU) 2016/1198 of 22 July 2016),

— accounting for amendments pertaining to the restrictions in relation to Diethylene Glycol Monoethyl Ether (DEGEE) (Commission Regulation (EU) 2016/314 of 4 March 2016),

— accounting for amendments pertaining to the restrictions in relation to permanent hair dyes (Commission Regulation (EU) 2017/237 of 10 February 2017).

These Regulations may be cited as the European Union (Cosmetic Products) (Amendment) Regulations 2017.
