I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Commission Regulation (EU) No. 1003/2014 of 18 September 20141 , Commission Regulation (EU) 2015/1298 of 28 July 20152 , Commission Regulation (EU) 2016/621 of 21 April 20163 and Commission Regulation (EU) 2016/622 of 21 April 20164 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Cosmetic Products) (Amendment) Regulations 2016.

(2) The Principal Regulations, the Regulations of 2015 and these Regulations may be cited together as the European Union (Cosmetic Products) Regulations 2013 to 2016 and shall be construed together as one.

2. In these Regulations—

“Principal Regulations” means the European Union (Cosmetic Products) Regulations 2013 ( S.I. No. 440 of 2013 );

“Regulations of 2015” means the European Union (Cosmetic Products) (Amendment) Regulations 2015 ( S.I. No. 512 of 2015 ).

3. Regulation 2(1) (as amended by Regulation 3 of the Regulations of 2015) of the Principal Regulations is amended by substituting for the definition of “EU Regulation” the following:

“‘EU Regulation’ means Regulation (EC) No. 1223/2009 of the European Parliament and of the Council of 30 November 20095 , as amended by Commission Regulation (EU) No. 344/2013 of 4 April 20136 , Commission Regulation (EU) No. 483/2013 of 24 May 20137 , Commission Regulation (EU) No. 658/2013 of 10 July 20138 , Commission Regulation (EU) No. 1197/2013 of 25 November 20139 , Commission Regulation (EU) No. 358/2014 of 9 April 201410 , Commission Regulation (EU) No. 866/2014 of 8 August 201411 , Commission Regulation (EU) No. 1003/2014 of 18 September 20141, Commission Regulation (EU) No. 1004/2014 of 18 September 201412 , point (1) of the Annex to Commission Regulation (EU) 2015/1190 of 20 July 201513 , Commission Regulation (EU) 2015/1298 of 28 July 20152, Commission Regulation (EU) 2016/621 of 21 April 20163 and Commission Regulation (EU) 2016/622 of 21 April 20164;”.

4. Regulation 18 (as amended by Regulation 4 of the Regulations of 2015) of the Principal Regulations is amended by deleting paragraph (4A).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the European Union (Cosmetic Products) Regulations 2013 to give effect to a number of Commission Regulations. These Regulations have the effect of—

— accounting for amendments pertaining to the restrictions in relation to methylchloroisothiazolinone and methylisothiazolinone (Commission Regulation (EU) No. 1003/2014 of 18 September 2014),

— prohibiting the use of 3-benzylidene camphor in cosmetic products (Commission Regulation (EU) 2015/1298 of 28 July 2015),

— authorising the use of zinc oxide (nano) and further restricting the use of zinc oxide as UV filters subject to criteria (Commission Regulation (EU) 2016/621 of 21 April 2016)

— accounting for amendments pertaining to the restrictions in relation to potassium hydroxide, including its use a callosity softener (Commission Regulation (EU) 2016/622 of 21 April 2016)

These Regulations may be cited as the European Union (Cosmetic Products) (Amendment) Regulations 2016.
