SOCIAL WELFARE (CONSOLIDATED CLAIMS, PAYMENTS AND CONTROL) (AMENDMENT) (No. 5) (PRESCRIBED TIME) REGULATIONS 2009

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd July, 2009.

The Minister for Social and Family Affairs, in exercise of the powers conferred on her by sections 4, 232 and 241 of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), hereby makes the following Regulations:

Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 5) (Prescribed Time) Regulations 2009.

(2) The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2009 and these Regulations shall be read together as one and these Regulations shall be included in the collective citation Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2009.

Prescribed time for making application for family income supplement

2. The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) are amended in article 182 by substituting the following paragraph for paragraph (c):

“(c) in the case of widow’s (contributory) pension, widower’s (contributory) pension, guardian’s payment (contributory), guardian’s payment (non-contributory), one-parent family payment and family income supplement, the period of 3 months from the day on which, apart from satisfying the condition of making a claim, the claimant becomes entitled thereto,”.

The Minister for Finance hereby consents to the making of the foregoing Regulations.

EXPLANATORY NOTE

(This Note is not part of the Instrument and does not purport to be a legal interpretation.)

These regulations provide that the prescribed time for making a claim for Family Income Supplement shall be the period of three months from the day on which the person becomes entitled to the payment.
