I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 2008/75/EC of 24 July 2008 1 , Commission Directive 2008/77/EC of 25 July 2008 2 , Commission Directive 2008/78/EC of 25 July 2008 3 , Commission Directive 2008/79/EC of 28 July 2008 4 , Commission Directive 2008/80/EC of 28 July 2008 5 , Commission Directive 2008/81/EC of 29 July 2008 6 , Commission Directive 2008/85/EC of 5 September 2008 7 and Commission Directive 2008/86/EC of 5 September 2008 8 , hereby make the following Regulations: | ||
1. These Regulations may be cited as the European Communities (Authorization, Placing on the Market, Use and Control of Biocidal Products) (Amendment) Regulations 2009. | ||
2. The European Communities (Authorization, Placing on the Market, Use and Control of Biocidal Products) Regulations 2001 ( S.I. No. 625 of 2001 ) are amended in Regulation 2(1), by substituting for the definition of “the Directive of 1998” the following— | ||
“ ‘Directive of 1998’ means Directive 98/8/EC of the European Parliament and of the Council of 16 February 1998, Commission Directive 2006/140/EC of 20 December 2006, Commission Directive 2007/20/EC of 3 April 2007, Commission Directive 2007/69/EC of 29 November 2007 and Commission Directive 2007/70/EC of 29 November 2007, Commission Directive 2008/15/EC of 15 February 2008 and Commission Directive 2008/16/EC of 15 February 2008, (from 1 November 2009) Commission Directive 2008/75/EC of 24 July 2008, (from 1 April 2010) Commission Directive 2008/78/EC of 25 July 2008, Commission Directive 2008/81/EC of 29 July 2008 and Directive 2008/86/EC of 5 September 2008, and (from 1 July 2010) Commission Directive 2008/77/EC of 25 July 2008, Commission Directive 2008/79/EC of 28 July 2008, Commission Directive 2008/80/EC of 28 July 2008, and Commission Directive 2008/85/EC of 5 September 2008;”. | ||
3. The European Communities (Authorization, Placing on the Market, Use and Control of Biocidal Products) (Amendment) (No. 2) Regulations 2008 ( S.I. No. 456 of 2008 ) are revoked. | ||

EXPLANATORY NOTE | ||

These Regulations give effect to various EC Directives relating to carbon dioxide, thiamethoxam, propiconazole, IPBC, cyclohexylhydroxydiazene 1-oxide, potassium salt (K-HDO), difenacoum, thiabendazole and tebuconazole. | ||
