EUROPEAN COMMUNITIES (SEED OF FODDER PLANTS) (AMENDMENT) REGULATIONS 2009

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 17th March, 2009.

I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive No. 2007/72/EC of 13 December 2007 1 and Commission Directive 2008/124/EC of 18 December 2008 2 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Seed of Fodder Plants) (Amendment) Regulations 2009.

2. The European Communities (Seed of Fodder Plants) Regulations, 2002 ( S.I. No. 198 of 2002 ) are construed and have effect as if the matter relating to Galega orientalis Lam. fodder galega contained in Commission Directive No. 2007/72/EC of 13 December 2007 were inserted into the Regulations in accordance with Article 1 of the Directive.

3. The European Communities (Seed of fodder plants) Regulations 2002 ( S.I. No. 198 of 2002 ) are amended by deleting—

(a) “, which Annex is contained in Schedule 1 hereto” in each place where it occurs, and

(b) Schedule 1.

4. A person shall not place on the market the seed of a fodder plant mentioned in Article 1(1) of Commission Directive 2008/124/EC of 18 December 2008 unless it has officially been certified as ‘basic seed’ or ‘certified seed’

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations amend Directive 66/401/EEC allowing for the fodder plant Galega orientalis Lam. to be covered by the uniform rules on seed certification. It also limits the marketing of seed of certain fodder plants to seed which has been officially certified as ‘basic seed’ or ‘certified seed’.
