IRISH AVIATION AUTHORITY (AERODROME STANDARDS) ORDER, 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 9th September, 2008.

The Irish Aviation Authority, in pursuance of the powers conferred on it by sections 5, 58 and 60 of the Irish Aviation Authority Act, 1993 (No. 29 of 1993), as amended, hereby orders as follows:

1. This Order may be cited as the Irish Aviation Authority (Aerodrome Standards) Order, 2008, and shall come into operation on the first day of October 2008.

2. In this Order:

“aerodrome” means a defined area on land or water, including any buildings, installations, and equipment, intended to be used either wholly or in part for the arrival, departure and surface movement of aircraft and also includes an area, whether on land or water or on a building or other structure or elsewhere, intended for use for landing or taking off by aircraft capable of descending or climbing vertically;

“the Authority” means The Irish Aviation Authority;

“the Act” means the Irish Aviation Authority Act, 1993 (No. 29 of 1993), as amended;

“Chicago Convention” has the meaning assigned to it by the Act;

“Standards and Recommended Practices” have the same meaning as defined in the Annexes to the Chicago Convention.

3. (1) The Irish Aviation Authority (Aerodrome Standards) Order 2000 ( S.I. No. 26 of 2000 ) is hereby revoked;

(2) Notwithstanding the revocation of the Irish Aviation Authority (Aerodrome Standards) Order 2000 ( S.I. No. 26 of 2000 ), any direction made or permission given under that Order and in effect on the date of the coming into operation of this Order, shall continue in effect and shall be deemed for all purposes to have been made under this Order.

4. The aeronautical safety standards referred to in Section 60(1)(b)(i) of the Act shall, where applicable, be the Standards specified in International Standards and Recommended Practices (Aerodromes) as set out in the Fourth Edition (July 2004) of Annexe 14 Volume 1 and Annexe 14 Volume II Second Edition (July 1995) to the Chicago Convention.

5. The Authority may require, by direction under this Order, that any or all of the provisions of Annexe 14 shall be applicable to an aerodrome in the State as may be specified in that direction.

6. The Authority may also require, by direction under this Order, that a chart or charts relating to an aerodrome in the State or to features of or associated with an aerodrome, and which comply as may be specified in such direction with the standards specified in the International Standards and Recommended Practices for Aeronautical Charts, as set out in the Tenth Edition (July 2001) of Annexe 4 to the Chicago Convention, shall be produced or otherwise made available to the Authority by the licensee or manager of the aerodrome concerned.

7. The Authority may exempt a person or an aerodrome from the provisions of a direction issued under this Order. Such an exemption may be made subject to conditions which shall be complied with by the person to whom or the aerodrome in respect to which the exemption relates.

8. Directions under this Order may be given in the form of Notices to Aerodrome Licensees or Managers, Aeronautical Information Circulars, Notices to Airmen (NOTAMs) or by notice sent by registered post to the person or organisation affected.

EXPLANATORY NOTE

(This Note is not part of the Order and does not purport to be a legal interpretation)

This Order provides for the application of the Standards of Annexes 4 and 14 to the Chicago Convention to Irish aerodromes and airports by a direction of the Authority appropriate to each application and updates the applicable edition of the Annexes. The definition of an “aerodrome” is included.
