GREYHOUND RACE TRACK (TOTALISATOR) (WIN JACKPOT) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 1st February, 2008.

Bord na gCon in exercise of the powers conferred on it by subsection (3) of Section 40 and by sub-section (3) of Section 5 of the Greyhound Industry Act, 1958 (No. 12 of 1958), hereby makes the following regulations, that is to say—

(1) These regulations may be cited as the Greyhound Race Track (Totalisator) (Win Jackpot) (Amendment) Regulations, 2007—

(2) The Greyhound Race Track (Totalisator) (Operating) Regulations, 1971 (No. 47 of 1971) are hereby amended as follows—

(i) by the deletion of Part VIII thereof entitled “Jackpot Pool” and the substitution therefore of the following articles entitled “Win Jackpot Pool”.

Purchase of Tickets

58. (a) Bets for the Jackpot can be made by use of selection cards. These cards are available at all Totalisator outlets.

(b) The Purchaser must mark his selected greyhounds in each of the selected Jackpot races by placing a vertical line through the centre of the box over the race card number of each greyhound selected.

(c) The card (which is not a Totalisator Ticket) must be handed in to a Jackpot Totalisator operator before the start of the first race on which the Jackpot is operated. The operator will then issue a ticket and return both ticket and card to the purchaser.

(d) It is the responsibility of the purchaser to verify that the ticket issued corresponds with the selection card. Mistakes can only be rectified before the START of the first Jackpot race.

Valid Tickets

59. Tickets purchased in respect of selections made are valid only for that meeting and except as provided in Article 68 of these regulations no refund of the purchase price or any part thereof shall be made.

Tickets lost or mislaid

60. The operator, his officers or servants shall not be liable if for any reason whatever a Jackpot Ticket is lost or mislaid.

Dead Heat

61. In the event of a dead heat for first place in any of the selected races, the dead heating greyhounds shall be deemed the winners of that selected race.

No unit on winning combination or combinations

62. If after completion of the selected races in the pool, the winning combination or combinations are unbacked then the operator may at his discretion:—

(a) Carry forward the net pool to be added either in whole or in such parts as the operator may determine to the net pool in a subsequent Jackpot Pool whether at the same or another greyhound track, or

(b) Carry forward the net pool in the manner provided in sub-paragraph (a) of this article, less such sum as the operator may decide to distribute amongst the holders of tickets who have nominated a combination containing the winning greyhounds in such number of races in the pool as the operator may determine.

Calculation of Dividend

63. The dividend shall be calculated by dividing the net pool by the total number of units on the winning combination or combinations of the selected races. Where the winning combination or combinations are unbacked and the operator decides to proceed under Article 62(b) of these regulations, then the sum to be distributed under that article shall be calculated on the combination or combinations containing the winning greyhounds in such number of races in the pool as the operator may determine.

Payment of Dividend

64. Dividends shall be payable on the presentation of the appropriate winning ticket or tickets whole and not unreasonably defaced or unrecognisable.

Withdrawn Greyhound

65. (a) If a greyhound is withdrawn from any of the selected races then the tickets bearing the number of the withdrawn greyhound shall be deemed to contain in lieu thereof, the race card number of the greyhound running in that race upon which the greatest number of units has been staked in the Tote Win Pool on that selected race.

(b) If an equal number of units in such selected race has been staked on two or more greyhounds running in that race and if the number is greater than the number of units staked in such selected race on any other runner in that race, then the ticket containing the race card number of any greyhound withdrawn as aforesaid from the race, shall be deemed to contain, in lieu thereof, the numerically lowest race card number of such equally backed greyhounds.

(c) If there are no units on any other greyhound in the selected race then the tickets bearing the number of the withdrawn greyhound shall be deemed to contain in lieu thereof, the greyhound with the numerically lowest race card number in that race.

(d) If for any reason it is, in the opinion of the operator, not possible to determine the number of the greyhound which should be substituted, every ticket containing the race card number of a greyhound withdrawn, shall be deemed to contain in lieu thereof the race card number of such greyhound as may be determined by the operator.

Race not run or declared a “no race”

66. If one or more of the selected races in the Jackpot at any meeting, is, for any reason, not run, not won, declared a “no race” or postponed to another race meeting each greyhound selected in the Jackpot for such race or races shall be deemed to be a winning greyhound and the remaining race or races will be deemed to form the Jackpot Pool at that meeting.

Minimum number of selected races

67. If for any reason less than the selected number of races in the pool is run, and won, then the dividend shall be calculated by dividing the net amount staked in the pool at that meeting, by the number of units on the winner of the last selected race in the pool which was run.

Jackpot Carryover

68. If in the event of a jackpot carryover at any meeting and if for any reason less than the selected number of races in the Pool is run, and won, the dividend shall be declared on the net amount staked in the pool at that meeting and the Jackpot Carryover shall be brought forward to a subsequent meeting.

Add-In

69. In the event of an add-in at any meeting and if for any reason less than the selected number of races in the pool is run, and won, the dividend shall be declared on the net amount staked in the pool at that meeting and the Jackpot add-in shall be brought forward to a subsequent meeting.

Abandoned or postponed Meeting

70. In the event of a meeting being abandoned or postponed before the completion of the first selected race then the pool shall be cancelled and the total amount staked in the pool at the meeting shall be refunded on presentation of tickets.

Selected races

71. Win Jackpot Pool means a pool for nominating the winning greyhounds in three, four, five, six, seven or eight selected races as the operator may determine.

Number of Runners

72. Win Jackpot Pools shall be held only on races in which there are at least two advertised runners.

General

73. Save as otherwise provided in these regulations the provisions of the Greyhound Race Track (Totalisator) (Operating) Regulations 1971 ( S.I. No. 47 of 1971 ) shall apply in respect of Bets made and accepted in the Win Jackpot Pool.

These regulations shall come into effect on the 13th day of November, 2007.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The effect of these regulations is to amend the Greyhound Race Track (Totalisator) (Operating) Regulations, 1971 to allow—

(i) in a multiple event pool for the purchase of tickets through the use of a selection card system.

(ii) the operation of Win Jackpot Pools on three, four, five, six, seven or eight races.
