EUROPEAN COMMUNITIES (PASSENGER CAR ENTRY INTO SERVICE) (AMENDMENT) REGULATIONS 2007.

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 14th December, 2007.

I, NOEL DEMPSEY, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2005/64/EC of the European Parliament and of the Council of 26 October 2005 1 and Directive 2006/40/EC of the European Parliament and of the Council of 17 May 2006 2 , in so far as they relate to the entry into service of motor vehicles, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Passenger Car Entry into Service) (Amendment) Regulations 2007.

2. The European Communities (Passenger Car Entry into Service) Regulations 2003 ( S.I. No. 552 of 2003 ) are amended by substituting for Schedule 2 (inserted by the European Communities (Passenger Car Entry into Service) (Amendment) (No. 2) Regulations 2006 ( S.I. No. 541 of 2006 )) the following:

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The European Communities (Passenger Car Entry into Service) Regulations 2003 ( S.I. No. 552 of 2003 ) implemented in Ireland entry into service provisions of a number of European Community Directives which deal with the type approval/entry into service of motor vehicles. The relevant EC Directives are listed in Schedule 2 to those Regulations.

Subsequent Regulations have been made amending S.I. No. 552 of 2003 , the latest being S.I. No. 541 of 2006 , by substituting a new Schedule 2 to take account of further directives subsequently adopted.

These Regulations further amend S.I. No. 552 of 2003 , as amended by S.I. No. 541 of 2006 , by substituting a new Schedule 2 to give effect in Irish law to the following additional Directives of the European Parliament and of the Council in regard to entry into service for passenger cars:

Directive 2005/64/EC (relating to the reusability, recyclability and recoverability of vehicles) and

Directive 2006/40/EC (relating to emissions from air-conditioning systems in motor vehicles).
