DISEASES OF ANIMALS ACT 1966 (FOOT AND MOUTH DISEASE) (DISINFECTION FACILITIES) ORDER 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 14th August, 2007.

The Minister for Agriculture and Food, in exercise of the powers conferred on her by sections 3, 13 and 28 (as amended by the Diseases of Animals (Amendment) Act 2001 (No. 3 of 2001)) of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 ), hereby order as follows:

1. This Order may be cited as the Diseases of Animals Act 1966 (Foot and Mouth Disease) (Disinfection facilities) Order 2007.

2. In this Order—

“authorised officer” means an authorised officer within the meaning of section 17A (inserted by the Diseases of Animals (Amendment) Act 2001 (No. 3 of 2001)) of the Diseases of Animals Act 1966 (No. 6 of 1966);

“premises” includes land (with or without buildings).

3. A person shall not operate—

(a) an establishment used for the slaughter, or in connection with the slaughter, of a bovine, ovine, porcine or caprine animal or other biungulate,

(b) a port, harbour or landing place where bovine, ovine, porcine or caprine animals or other biungulates are landed, or

(c) a mart, market, fair, show, lairage or other place where bovine, ovine, porcine or caprine animals or other biungulates are gathered,

unless there are present on, or adjacent to, the premises adequate facilities for washing, cleansing and disinfecting vehicles or other equipment used in connection with the transport of a bovine, ovine, porcine or caprine animal or other biungulate.

4. A person who has transported a bovine, ovine, porcine or caprine animal or other biungulate to a premises referred to in Article 2 shall not depart the premises until the vehicle and other equipment used in connection with the transport of the animal has been thoroughly washed, cleansed and disinfected in accordance with the direction (if any) of an authorised officer.

5. (1) An authorised officer may give a direction—

(a) requiring that particular facilities or facilities of a particular standard for the cleansing and disinfecting of a vehicle or other equipment be operated at a premises to which Article 2, refers,

(b) that facilities be operated in a particular manner or to a particular standard, or

(c) relating to a particular vehicle or equipment or to vehicles or equipment of a particular class or description.

(2) A person shall comply with a direction under paragraph (1).

This Order requires that cleansing and disinfecting facilities are available and used at slaughterhouses, marts and other places where animals susceptible to foot and mouth disease may gather.
