ABATTOIRS ACT 1988 (VETERINARY EXAMINATION) (SALMONELLA IN PIGS) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 16th March, 2007.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 39 and 63 of the Abattoirs Act 1988 (No. 8 of 1988) as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 ), hereby make the following Regulations—

1. These Regulations may be cited as the Abattoirs Act 1988 (Veterinary Examination) (Salmonella in Pigs) Regulations 2007.

2. A veterinary inspector may declare meat that is the liver, lungs, viscera or meat of the head of a pig to be unfit for human consumption unless—

(a) the pig comes from a herd—

(i) in respect of which there exists at the time of slaughter a valid certificate of categorisation (within the meaning of the Diseases of Animals Act 1966 (Salmonella in Pigs) Order 2007) indicating that the herd is categorised as category 1 or 2, or

(ii) if no valid certificate of categorisation exists at the time of slaughter, a negative result was obtained in the case of at least 50% of serological tests conducted on each of 24 pigs from the herd and a negative result was obtained in a microbiological test conducted on a pooled sample of lymph nodes taken from 5 pigs from the herd, both tests having been conducted within 5 months prior to slaughter by a laboratory approved under the aforementioned Order, or

(b) the meat has been subjected to—

(i) heat treatment to produce a minimum temperature of 72° C throughout the meat in an establishment approved for the time being under the European Communities (Food and Feed Hygiene) Regulations 2005 ( S.I. No. 910 of 2005 ), or

(ii) an other treatment approved for the time being by the Minister for the purpose of this paragraph.

3. Meat declared to be unfit for human consumption shall be—

(a) immediately isolated from other meat by the occupier of the establishment,

(b) marked by a veterinary inspector or the occupier of the establishment at the direction of the veterinary inspector with multiple deep incisions by means of a knife, or by any other means which the veterinary inspector considers appropriate,

(c) stained by a veterinary inspector or the occupier of the establishment at the direction of the veterinary inspector with a green staining ink, or other officially approved marking material, suitable for staining and denaturing unfit meat,

(d) stored by the occupier of the abattoir in a waste container for unfit meat, which shall be kept locked, when so required by the veterinary inspector and stored in accordance with the Abattoirs Act 1988 (Abattoirs) Regulations 1989 ( S.I. No. 152 of 1989 ), and

(e) disposed of, denatured or destroyed (whether by way of rendering, incineration or burning or by other means) by or on behalf of the occupier of the establishment in accordance with the directions of the veterinary inspector.
