FISHERY HARBOUR CENTRES (FIXED PAYMENT NOTICE) BYE-LAWS 2006

I, John Browne, Minister of State at the Department of Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 4(10) (inserted by section 54 of the Maritime Safety Act 2005 (No. 11 of 2005)) of the Fishery Harbour Centres Act 1968 (No. 18 of 1968) and the Marine (Delegation of Ministerial Functions) Order 2006 ( S.I. No. 82 of 2006 ), hereby make the following Bye-laws:

1.          These Bye-laws may be cited as the Fishery Harbour Centres (Fixed Payment Notice) Bye-laws 2006.

2.          In these Bye-laws “Act” means Fishery Harbour Centres Act 1968 (No. 18 of 1968).

3.          The form specified in the Schedule is the form of the notice to be served on a person in relation to an alleged offence under section 4(6)(a) of the Act.

4.          The amount specified to accompany a notice under section 4(10) of the Act is €150.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Bye-laws prescribe the form of Fixed Payment Notice and a Fixed Payment of €150 (“on-the-spot-fine”) in lieu of prosecution, if appropriate, in relation to an alleged offence involving contravention of any bye-law or order made under section 4 of the Fishery Harbour Centres Act 1968 (No. 18 of 1968).
