District Court (Safety, Health and Welfare at Work Act 2005) Rules 2006

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act 1924 , section 72 of the Courts of Justice Act 1936 , section 34 of the Courts (Supplemental Provisions) Act 1961 and section 24 of the Interpretation Act 2005 , do hereby, with the concurrence of the Minister for Justice, Equality and Law Reform, make the following rules of court:-

1.   These rules may be cited as the District Court (Safety, Health and Welfare at Work Act 2005) Rules 2006.

2.   These rules shall come into operation on the 22nd day of May 2006 and shall be read together with all other District Court rules for the time being in force.

3.   The District Court Rules 1997 ( S.I. No. 93 of 1997 ) shall be amended by the insertion immediately following rule 4 of Order 100 of the following rule:

“5.  (1) In this rule-

the “Act of 2005” means the Safety Health and Welfare at Work Act 2005 (No. 10 of 2005).

(2)                   Where an appeal has been brought in the manner prescribed under -

(a)  section 66(7) of the Act of 2005 against an improvement notice,

(b)  section 67(7) of the Act of 2005 against a prohibition notice, or

(c)  section 72(3) of the Act of 2005 against an information notice,

an order of the Court made on such application shall be in the Form 100.3, Schedule D and the applicant shall cause the said order to be served upon the respondent and upon any other person directly affected by the said order.

(3)                   Where an application has been brought in the manner prescribed under section 67(6) of the Act of 2005 for the suspension of a prohibition notice, an order of the Court made on such application directing that the operation of a prohibition notice be suspended shall be in the Form 100.4, Schedule D and the applicant shall cause the said order to be served upon the respondent and upon any other person directly affected by the said order.”

4.   The Forms in the Schedule hereto shall be added to the Forms in Schedule D to the District Court Rules 1997 ( S.I. No. 93 of 1997 ), immediately following Form 100.2.
