SOCIAL WELFARE LAW REFORM AND PENSIONS ACT 2006 (SECTIONS 26 and 27) (COMMENCEMENT) ORDER 2006

The Minister for Social and Family Affairs, in exercise of the powers conferred on him by section 1 of the Social Welfare Law Reform and Pensions Act 2006 (No. 5 of 2006), hereby orders as follows:

Citation.

1.  This Order may be cited as the Social Welfare Law Reform and Pensions Act 2006 (Sections 26 and 27) (Commencement) Order 2006.

Commencement.

(a)  The 24th day of April 2006 is appointed as the day on which section 26 of the Social Welfare Law Reform and Pensions Act 2006 (No. 5 of 2006), comes into operation;

(b)  The 29th day of May 2006 is appointed as the day on which section 27 of the Social Welfare Law Reform and Pensions Act 2006 , in so far as it relates to one-parent family payment (other than where payable in respect of a widow or widower comes into operation; and

(c)  The 30th day of may is appointed as the day on which section 27 of the Social Welfare Law Reform and Pensions Act 2006 , in so far as it relates to one-parent family payment payable in respect of a widow or widower, comes into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order provides for the commencement of Sections 26 and 27 of the Social Welfare Law Reform and Pensions Act 2006 .

Section 26 provides for a technical amendment to clarify that it is the means of an orphan that is to be assessed when determining entitlement to Orphan's (Non-Contributory) Pension.

Section 27 raises the maximum income limit for recipients of One-Parent Family Payment to €375 from €293.
