PRIVATE SECURITY (FORMS, SURRENDER OF LICENCE AND OFFENCE NOTIFICATION) REGULATIONS 2006

The Private Security Authority, in exercise of the powers conferred on it by Section 51 of the Private Security Act 2004 (No. 12 of 2004) and with the consent of the Minister for Justice, Equality and Law Reform hereby makes the following regulations:

1.         These Regulations may be cited as the Private Security (Forms, Surrender of Licence and Offence Notification) Regulations 2006.

2.         These Regulations come into operation on the 29 day of March 2006.

3.         A licence shall be in the form specified in Schedule 1 to these Regulations or a form to the like effect.

4.         An identity card shall be in the form specified in Schedule 2 to these Regulations or a form to the like effect.

5.         A licence and an identity card shall contain the security features required by the Authority.

6.         An entry in the Register shall be in a form specified in Schedule 3 to these Regulations or a form to the like effect. The Register shall be in a form comprised of a series of such entries.

7.         A licensee shall surrender an expired licence and any identity card issued to the licensee within one month of the expiry of the licence by sending the licence and identity card to the Authority by registered post.

8.         Where a licence has been revoked or suspended, the licensee shall either:

(a)       deliver the licence to an inspector, at such time and place specified by the Authority, together with any identity card issued to the licensee;

(b)       if so requested in writing by the Authority, send the licence and identity card to the Authority by registered post within seven days of the request by the Authority.

9.         For the purposes of section 36 (1) of the Act, a licensee shall notify the Authority of a conviction in writing within 3 months of the conviction. The notification shall include particulars of the offence and the sanction imposed and be accompanied by a copy of the Court order in respect of the conviction or equivalent order made in another jurisdiction.

10.       For the purposes of the said section 36 (1), a licensee shall notify the Authority in writing of any proceedings for an offence (other than a prescribed offence) under the law of the State or another State pending against the licensee within 3 months of the institution of the proceedings. The notification shall include particulars of the proceedings and be accompanied by a copy of the summons or other document instituting the proceedings.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation.)

These Regulations prescribe -

(a)      the form of licences and identity cards to be issued under the Private Security Services Act 2004 (No. 12 of 2004),

(b)      the form of register of licensees to be established and maintained by the Private Security Authority,

(c)      procedures in relation to the surrender of expired, revoked or suspended licences and procedures in relation to the surrender of identity cards issued in respect of such licences,

(d)      procedures in relation to the notification by licensees of convictions and proceedings pending against licensees.
