Statistics (Census of Population) Order 2005

I, Tom Kitt, Minister of State at the Department of the Taoiseach, in exercise of the powers conferred on me by section 25(1) of the Statistics Act 1993 (No. 21 of 1993) and the Statistics (Delegation of Ministerial Functions) Order 2004 ( S.I. No. 664 of 2004 ), hereby order as follows:

1.         (1)       This Order may be cited as the Statistics (Census of Population) Order 2005.

(2)       In this Order, unless the contrary intention appears -

“census night” means the period of time commencing at 9 o'clock in the evening of Sunday 23 April 2006 and ending at 7 o'clock in the morning of Monday, 24 April 2006;

“following morning” means the period of time commencing at one minute past 7 o'clock in the morning of Monday, 24 April 2006 and ending at midday on that day.

(3)       In this Order a reference to an Article or a Schedule is a reference to an Article of, or a Schedule to, this Order, unless it is indicated that reference to some other Order is intended.

2.         Information, the general nature of which is specified in Schedule 1 to this Order, is prescribed as information required to be provided for the purposes of the Census of Population to be conducted in the year 2006.

3.         Subject to Article 4, the persons or classes of persons specified in Schedule 2 are prescribed as the persons or classes of persons by whom the relevant information referred to in Article 2 is required to be provided, which information shall be provided by the completion of forms and questionnaires prepared by the Director General of the Central Statistics Office in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993).

4.         (1)       A person to whom paragraph 1 of Schedule 2 applies is required to provide -

(a)      in respect of a private household that is occupied by such person on census night or on the following morning, he or she not having been enumerated elsewhere on that night or morning, information, the general nature of which is specified in paragraph 1 of Schedule 1,

(b)      in respect of each other person who occupies that private household on census night or on the following morning, such other person or persons not having been enumerated elsewhere, information, the general nature of which is specified in paragraph 2 of Schedule 1,

(c)      information as to whether any or all members of the private household were temporarily absent from the household on census night and the following morning and, where all members of the private household were so absent, in respect of each member of the household who was so absent, the address or addresses at which he or she resided on that night and morning, and

(d)      where some but not all members of the private household are temporarily absent from the private household on census night and the following morning, in respect of each person who is so absent information, the general nature of which is specified in paragraph 3 of Schedule 1.

(2)       A person to whom paragraph 2 or 3 of Schedule 2 applies is required to provide information, the general nature of which is specified in paragraph 5 of Schedule 1.

(3)       A person to whom paragraph 4 of Schedule 2 applies is required to provide information, the general nature of which is specified in paragraph 2 of Schedule 1.

5.         Information required to be provided by virtue of this Order shall be provided in respect of the circumstances existing on census night or on the following morning, as appropriate.

SCHEDULE 1

General nature of the information to be provided for the purpose of the Census of Population to be conducted in the year 2006.

1.        In respect of housing characteristics and facilities of a private household:

(i)         type of accommodation;

(ii)        age of building;

(iii)        nature of occupancy;

(iv)        rent paid;

(v)         number of rooms;

(vi)        central heating;

(vii)       type of water supply;

(viii)      sewerage facilities;

(ix)        number of cars and vans;

(x)         possession of a personal computer;

(xi)        access to the internet.

2.        In respect of each person referred to in paragraphs (1)(b) and (3) of Article 4:

(i)         first name, surname and sex;

(ii)        relationship of each person referred to in Article 4(1)(b) to the person on whom the requirement set out in Article 4(1) is imposed and to each other, to the extent that the forms permit;

(iii)       date of birth;

(iv)       place of birth;

(v)        nationality;

(vi)       usual residence;

(vii)      usual residence on the date falling one year prior to 23 April 2006;

(viii)     country of last residence and year of taking up residence in the State;

(ix)       marital status;

(x)        where the person is a woman, number of children born alive to her;

(xi)       knowledge of the Irish language;

(xii)      religion;

(xiii)     ethnic or cultural background;

(xiv)     disability - long lasting condition and difficulty in doing certain activities;

(xv)      usual means of travel to place of work, school or college, time of leaving home, distance travelled and time taken;

(xvi)     provision of regular, unpaid personal help;

(xvii)    age at which full-time education ceased and the highest level of education completed;

(xviii)    third level qualifications held;

(xix)     participation in voluntary activities, without pay, in the 4 weeks prior to census night;

(xx)      present principal economic status, present employment status, present occupation, full address where work carried out, name of present employer and such employer's business;

(xxi)     in the case of an unemployed person, previous employment status previous occupation, full address where work was carried out, name of last previous employer and such employer's business;

(xxii)    in the case of a retired person, previous employment status and previous occupation.

3.        In respect of each person referred to in Article 4(1)(d):

(i)        first name, surname and sex;

(ii)        relationship to each other person resident in the private household on census night or on the following morning, to the extent that the forms permit;

(iii)       date of birth;

(iv)       marital status;

(v)        length of absence from household;

(vi)       whether or not in the State;

(vii)      whether a student away at school or college.

4.         In respect of each person referred to in Article 4(1)(c), the address or addresses at which each member of the household who was so absent resided on that night and morning.

5.        In respect of a residential communal establishment referred to in paragraph 2 of Schedule 2 and a vessel referred to in paragraph 3 of Schedule 2:

(a)        a description of the nature of the establishment concerned;

(b)        a list of the names of the persons who occupied that establishment on census night;

(c)        confirmation in respect of each person so listed as to whether an individual form was issued to and collected from such person.

SCHEDULE 2

The persons, or classes of persons, by whom the relevant information specified in Schedule 1 is required to be provided.

1.        The householder or any adult member of a private household.

2.        The manager or other person in charge of a residential communal establishment such as a hospital, nursing home or children's home, educational establishment, religious community, defence establishment, prison, shelter or refuge, hotel, boarding house, guest house, bed and breakfast, hostel or campsite or other residential communal establishment of any kind (excluding private households).

3.        The master in charge or other person in charge of a vessel (other than a vessel comprising a private household) in any harbour, port, bay, creek, lake, river, canal or elsewhere in waters within the jurisdiction of the State.

4.        Any other individual in respect of whom the information prescribed by Article 2 is not required by this Order to be provided by another person or is not provided by another person.
