District Court (Estreatment of Recognisances) Rules 2005

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act 1924 , section 72 of the Courts of Justice Act 1936 , section 17 of the Interpretation Act 1937 [as applied by section 48 of the Courts (Supplemental Provisions) Act 1961 ] and section 34 of the Courts (Supplemental Provisions) Act 1961 , do hereby, with the concurrence of the Minister for Justice, Equality and Law Reform, make the following rules of court:-

1 These rules may be cited as the District Court (Estreatment of Recognisances) Rules 2005.

2 These rules shall come into operation on the 7^th day of December 2005 and shall be read together with all other District Court rules for the time being in force.

3 The Form numbered 27.7 in Schedule 1 hereof shall be substituted for the form numbered 27.7 in Schedule B of the District Court Rules 1997 ( S.I. No. 93 of 1997 ).

EXPLANATORY NOTE

(This does not form part of the instrument and does not purport to be a legal interpretation)

These Rules amend the statutory declaration in Form 27.7 to reflect the modes of service available in respect of notices of application for estreatment, as provided for in Order 27 rule 3 (3) which expressly refers to ordinary post and, via Order 10 rule 3(1) offers the possibility (under Order 10 rule 5) of personal service, service by leaving the notice at the last or most usual place of abode, or service on the parties mentioned in Order 10 rule 5.

^* This declaration shall be made not earlier than ten days after the day on which the envelope is posted, where service by post is applicable.
