International Carriage Of Perishable Foodstuffs (Amendment of Fees) Regulations, 2005

I, Mary Coughlan, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 15 of the INTERNATIONAL CARRIAGE OF PERISHABLE FOODSTUFFS ACT, 1987 (No. 20 of 1987), (as adapted by the International Carriage Of Perishable Foodstuffs (Consolidation) Regulations, 1993 ( S.I. No. 188 of 1993 )), and the International Carriage of Perishable Foodstuffs Act 1987 (Transfer of Departmental Administration and Ministerial Functions) Order 1993 ( S.I. No. 397 of 1993 ) (as adapted by the Agriculture Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 306 of 2002 )), hereby make the following regulations:

1.  These regulations may be cited as the International Carriage Of Perishable Foodstuffs (Amendment of Fees) Regulations 2005.

2.  In these regulations:

“Principal Regulations” means The International Carriage of Perishable Foodstuffs (Consolidation) Regulations, 1993 (No. 188 of 1993).

3.  The Principal Regulations are hereby amended by the substitution of the Schedule to these regulations for the Schedule to the Principal Regulations.

4.  The Fees set out in Parts I (Tests) & Part II (Type approval) of the schedule to these Regulations are in Pounds Sterling. (GB£Stg)

5.  The Fees set out in Part III (Examinations & Certification) of the schedule to these Regulations are in EURO (EU€).

6.  The Certifying Authority shall be entitled to be paid their reasonable expenses in addition to the fees set out in the Schedule to these Regulations.

PART I: TESTS

 

 

Cost (GB£Stg)

1.

Fee for the testing of a unit of transport equipment

GB£1114

2.

Fee in respect of the use of the facilities of a designated test station for each day, or part of a day, in which such facilities are used for the purpose of the testing of a unit of transport equipment (2 days required)

GB£450/day

3.

Fee for the certification of a unit of transport equipment which has been tested (tests report)

GB£165

PART II: TYPE APPROVAL

 

 

Cost (GB£Stg)

1.

Type approval fee for the testing of a unit of transport equipment

GB£925

2.

Fee in respect of the use of the facilities of a designated test station for each day, or part of a day, in which such facilities are used for the purpose of the testing of a unit of transport equipment as type equipment (2 days required)

GB£450/day

 

Type Equipment Certification

 

3.

Certificate of compliance (not payable except if the type approval abandoned after the test)

PART III (EXAMINATIONS AND CERTIFICATION)

Examinations

 

1.

Per day, (or part thereof) Fee for the examination of a unit or number of units of transport equipment being:

 

(a)  Insulated equipment or

€1200

(b)  Refrigerated or mechanically refrigerated or heated equipment

 

2.

Certification

 

Fee for the certification of a unit of transport equipment which

 

(a)  has been tested or

 

(b)  certifying authority is satisfied conforms with type equipment or

EU€100

(c)  has been examined

 

Certificate of Compliance & plate.

These regulations update the fees contained in previous regulations with respect to testing, type approval, examination and certification activities associated with the International Transport of Perishable Foodstuffs (ATP).
