European Communities (Amendment of Cruelty to Animals Act 1876) Regulations 2005

I, Mary Harney, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 and for the purpose of giving effect to Directive 2003/65/EC1 of the European Parliament and of the Council of 22 July 2003, amending Council Directive 86/609/EEC2 on the approximation of the laws, regulations and administrative provisions of the Member States regarding the protection of animals used for experimental and other purposes, hereby make the following regulations:

1.         These regulations may be cited as the European Communities (Amendment of Cruelty to Animals Act 1876) Regulations 2005.

2.         The Cruelty to Animals Act 1876, 39 & 40 Vict., Ch.77, 1876, as amended by the European Communities (Amendment of Cruelty to Animals Act, 1876 Regulations 2002 is further amended by inserting the following after section 5A(3):

“(4)  Changes to Annexes to Directive 86/609/EEC shall be adopted in accordance with the regulatory procedures set out below:

(a)  The Commission shall be assisted by a Committee.

(b)  Articles 5 and 7 of Decision 1999/468/EC3 shall apply, having regard to the provisions of Article 8 thereof. The period laid down in Article 5(6) of Decision 1999/468/EC shall be set at three months.

(c)  The Committee shall adopt its rules of procedure.”

These Regulations give effect to Directive 2003/65/EC of the European Parliament and of the Council amending Council Directive 86/609/EEC on the approximation of law, regulations and administrative provisions of the Member States regarding the protection of animals used for experimental and other scientific purposes.
