Disabled Drivers and Disabled Passengers (Tax Concessions)(Amendment)(No. 2) Regulations 2005


Made by the Minister for Finance

I, Brian Cowen, Minister for Finance, in exercise of the powers conferred on me by section 92 (as amended by section 17 of Finance (No. 2) Act 1992 (No. 28 of 1992)) of the Finance Act 1989 (No. 10 of 1989), and after consultation with the Minister for Health and Children (as adapted by the Health (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 308 of 1997 )) and the Minister for the Environment, Heritage and Local Government (as adapted by the Environment and Local Government (Alteration of Name of Department and Title of Minister) Order 2003 ( S.I. No. 233 of 2003 )), hereby make the following regulations:

1.      These Regulations may be cited as the Disabled Drivers and Disabled Passengers (Tax Concessions)(Amendment)(No. 2) Regulations 2005.

2.      Regulation 6 (inserted by the Disabled Drivers and Disabled Passengers (Tax Concessions)(Amendment) Regulations 2004 ( S.I. No. 469 of 2004 )) of the Disabled Drivers and Disabled Passengers (Tax Concessions) Regulations 1994 ( S.I. No. 353 of 1994 ) is amended -

(a)        in paragraph (1)(a) (as amended by the Disabled Drivers and Disabled Passengers (Tax Concessions)(Amendment) Regulations 2005 ( S.I. No. 178 of 2005 )) by substituting “the Minister for Finance shall appoint a minimum of 5 medical practitioners” for “the Minister for Finance shall appoint 5 medical practitioners and may appoint a further 5 medical practitioners”, and

(b)        by deleting paragraph (2).

3.      Nothing in these Regulations shall read as affecting an appointment made by the Minister for Finance to the Medical Board before the making of these Regulations.

Explanatory Note

These Regulations amend the principal regulations on the tax concessions scheme for disabled drivers and disabled passengers. Formerly the number of appointments to the Medical Appeal Board for the Scheme was limited to 10; these Regulations remove that limitation. They also remove the restriction on an appointee's tenure to the remaining term of the appointee that he or she replaces.
