SEA FISHERIES (WEIGHING PROCEDURES FOR HERRING, MACKEREL AND HORSE MACKEREL) REGULATIONS 2005.

I, NOEL DEMPSEY, Minister for Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving full effect to Council Regulation (EC) No. 1954/2003 of 4 November 20031 and Council Regulation No. 1415/2004 of 19 July 20042 , hereby make the following regulations:

1.  These Regulations may be cited as the Sea Fisheries (Weighing Procedures for Herring, Mackerel and Horse Mackerel) Regulations 2005.

2.  The Sea Fisheries (Weighing Procedures for Herring Mackerel and Horse Mackerel) (No. 4) Regulations 2004 (S.I. 530 of 2004) is amended by substituting for Regulation 7 of those Regulations the following Regulation:

“7.   The ports designated for the purpose of the Annex are Killybegs, Ros an Mhíl, Castletownbere, An Daingean Rathmullan, and Ringaskiddy in the Port of Cork. All landings into these ports, which are subject to the provisions of the Annex, must be weighed by means of weighbridges located in the ports.”

These Regulations amend Section 7 of the Sea Fisheries (Weighing Procedures for Herring, Mackerel and Horse Mackerel (No. 4) Regulations 2004 (S.I. 530 of 2004). The amendment adds Ringaskiddy in the Port of Cork as a designated port.
