EUROPEAN COMMUNITIES (MARKETING OF FRUIT PLANT PROPAGATING MATERIAL AND FRUIT PLANTS INTENDED FOR FRUIT PRODUCTION) (AMENDMENT) REGULATIONS 2004.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2003/111/EC of 26 November 20031 , hereby make the following Regulations:

1.  These Regulations may be cited as the European Communities (Marketing of Fruit Plant Propagating Material and Fruit Plants Intended for Fruit Production) (Amendment) Regulations 2004.

2.  The European Communities (Marketing of Fruit Plant Propagating Material and Fruit Plants Intended for Fruit Production) Regulations 1994 ( S.I. No. 160 of 1994 ) are amended in Regulation 2(1) by substituting the following for the definition of “The Directive”—

“‘The Directive’ means Council Directive No. 92/34 EEC of 28 April 1992, Commission Directive 93/48/EEC of 23 June 1993, Commission Directive 93/79/EEC of 21 September 1993 and Commission Directive 2003/111/EC of 26 November 2003;”.

These Regulations relate to additional fruit genera and species which were not included in Annex II to Council Directive 92/34/EEC.
