S.I. No. 401/2003 - Inland Post Amendment (No. 70) Scheme, 2003


An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act 1983 (No. 24 of 1983) as amended by Regulation 8 (4) of the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ), and with the concurrence of the Commission for Communications Regulation to the increases in charges herein made, hereby makes the following Scheme:

1.     This Scheme may be cited as the Inland Post Amendment (No. 70) Scheme 2003.

2.     This Scheme shall be operative with effect from the 30th day of August 2003.

3.     In this Scheme, “the Principal Warrant” means the Inland Post Warrant 1939 ( S.I. No. 202 of 1939 ) as amended;

“Scheme No. 36” means the Inland Post Amendment (No. 36) Scheme, 1986 ( S.I. No. 362 of 1986 );

“Scheme No. 57” means the Inland Post Amendment (No. 57) Scheme, 1998 ( S.I. No. 129 of 1998 );

“Scheme No. 59” means the Inland Post Amendment (No. 59) Scheme 1998 ( S.I. No. 133 of 1998 );

“Scheme No. 62” means the Inland Post Amendment (No. 62) Scheme 2000 ( S.I. No. 320 of 2000 );

“Scheme No. 66” means the Inland Post Amendment (No. 66) Scheme 2002 ( S.I. No. 634 of 2002 ).

4.     All rates and charges payable upon letters and postal packets in this Scheme pertain to postal packets within the “reserved area” as defined by the European Communities (Postal Services) Regulations 2002 ( S.I. No. 616 of 2002 ).

5.     Words defined in the Principal Warrant shall have the same meaning in this Scheme.

6.     The First Schedule to Scheme No. 36 is hereby amended by the substitution for the entries therein contained (inserted by Regulation 6 of Scheme No. 66) of the entries in the Schedule to this Scheme.

7.     Regulation 10 of Scheme No. 36, as amended by Regulation 20 of Scheme No. 57, is hereby amended by the substitution for Regulation 10.1 of the following paragraph:

“There shall be charged and paid upon postal packets posted together under the Postaim Service the rates specified in the First Schedule as appropriate to the weight and size of the said postal packets and as appropriate to the volume of postal packets so posted in the Postaim Service.”

8.     Regulation 10.2 of Scheme No. 36, as inserted by Regulation 20 of Scheme No. 57 is hereby revoked.

9.     Scheme No. 59 is hereby revoked.

10.   Any licences issued by An Post to customers pursuant to Scheme No. 59 are hereby revoked.

11.   Scheme No. 62 is hereby revoked.

12.   Regulation 8 and the Second Schedule to Scheme No. 66 are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Scheme applies to the Inland Post Service and shall be operative from the 30th day of August, 2003. It authorises increases in the rates of postage and fees charged for postage of items in the Inland Service for Postaim within the reserved area as defined in the European Communities (Postal Services Regulations 2002 ( S.I. No. 616 of 2002 ), abolishes Postaim postage prepaid envelopes and provides for the cessation of An Post's Loyalty Mail Service as defined in the Inland Post Amendment (No. 59) Scheme, 1998 ( S.I. No. 133 of 1998 ).
