S.I. No. 318/2003 - Communications Regulation Act 2002 (Notice of Intention To Prosecute) Regulations 2003


I, Dermot Ahern T.D., Minister for Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 44 (1) of the Communications Regulation Act 2002 (No. 20 of 2002), hereby make the following regulations:

1.        These Regulations may be cited as the Communications Regulation Act 2002 (Notice of Intention to Prosecute) Regulations 2003.

2.        The form set out in the Schedule to these Regulations is prescribed for the purposes of section 44 (1) of the Communications Regulation Act 2002 (No. 20 of 2002.

A prosecution in respect of the alleged offence will not be instituted during the period of 21 days beginning on the date of this notice.

If during the period of 21 days you -

(a)        remedy to the satisfaction of the Commission for Communications Regulation any default that constitutes the offence, and

(b)        pay to the Commission the sum of €1,000 accompanied by this notice,

a prosecution in respect of the alleged offence will not be instituted.
