ANNEXE 12 (STANDARDS AND RECOMMENDED PRACTICES SEARCH AND RESCUE) (DESIGNATION OF AUTHORITIES) ORDER, 1995.

I, MICHAEL LOWRY, Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 11 (a) of the Air Navigation and Transport Act, 1946 (No. 23 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order) 1987 ( S.I. No. 92 of 1987 ), as adapted by the Tourism, Transport and Communications (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 17 of 1993 ), hereby order as follows:

1. This Order may be cited as the Annexe 12 (Standards and Recommended Practices Search and Rescue) (Designation of Authorities) Order, 1995.

2. (1) The Minister shall be the authority by which any of the powers exercisable under Annex 12 of the Chicago Convention other than the powers in relation to Rescue Co-ordination Centres and Rescue Co-ordination Sub-Centres in the State are to be exercised in the State.

(2) The Irish Aviation Authority shall be the authority by which any of the powers exercisable under Annexe 12 of the Chicago Convention in relation to Rescue Co-ordination Centres and Rescue Co-ordination Sub-Centres are to be exercised in the State.

EXPLANATORY NOTE.

This Order, in conjunction with the Irish Aviation Authority Act, 1993 (Amendment of Schedule) Order, 1995 ( S.I. No. 171 of 1995 ), provides that the Minister shall be the authority by which the powers exercisable under Annexe 12 of the Chicago Convention, other than the powers concerning Rescue Co-Ordination Centres and Sub-Centres, are to be exercised in the State; and the Irish Aviation Authority (by virtue of the inclusion of the said Annexe 12 in the Schedule to the Irish Aviation Authority Act, 1993 ), shall be the authority by which any of the powers exercisable under Annex 12, in relation to the Rescue Co-ordination Centres and Sub-Centres are to be exercised in the State.
