FUELS (CONTROL OF SUPPLIES) (STRATEGIC STORAGE OF PETROLEUM OILS) ORDER, 1990.

WHEREAS there is for the time being in force an order (entitled the Petroleum Oils (Regulation or Control of Acquisition, Supply, Distribution or Marketing) Order, 1983 ( S.I. No. 1 of 1983 )) under section 2 (inserted by the Fuels (Control of Supplies) Act, 1982 (No. 18 of 1982)) of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971);

Now, I, ROBERT MOLLOY, Minister for Energy, in exercise of the powers conferred on me by section 3 (as amended by section 3 of the Fuels (Control of Supplies) Act, 1982 ) of the Fuels (Control of Supplies) Act, 1971 (as adapted by the Industry and Energy (Alteration of Name of Department and Title of Minister) Order, 1983 ( S.I. No. 385 of 1983 )) hereby order as follows:

1. This Order may be cited as the Fuels (Control of Supplies) (Strategic Storage of Petroleum Oils) Order, 1990.

2. In this Order—

"authorised officer" means a person appointed by the Minister under Article 7 of this Order to be an authorised officer for the purposes of this Order;

"the Corporation" means The Irish National Petroleum Corporation Limited;

"the jetty" means the offshore oil jetty situate at Bantry Bay and its associated works, facilities and equipment;

"the Minister" means the Minister for Energy;

"the terminal" means the oil terminal situate at Whiddy Island in Bantry Bay and its associated works, facilities and equipment.

3. For the purpose of maintaining supplies of petroleum oils the Corporation is hereby authorised to store at the terminal and remove therefrom for use, distribution or marketing petroleum oils.

4. The Minister or an authorised officer may grant or issue authorisations or licences or give such directions as he thinks fit to the Corporation in respect of the matters authorised by Article 3 of this Order.

5. For the purpose of complying with Article 3 of this Order, the Corporation is hereby authorised to use the jetty for the berthing of vessels and the loading or off-loading of cargoes of petroleum oils into and out of the terminal.

6. The Minister or an authorised officer may give such directions as shall appear to him to be necessary or expedient for giving full effect to any provision of this Order.

7. (1) The Minister may appoint persons to be authorised officers for the purposes of this Order and may revoke any such appointment.

(2) An authorised officer shall be furnished with a warrant of his appointment and when exercising any power to which the provisions of this Order apply shall, if so required, produce the warrant to any person affected.

(3) A copy of a document purporting to be a warrant under paragraph (2) of this Article produced by a person and purporting to be signed by the Minister shall be received in evidence and be deemed to be sufficient evidence of the authorisation of that person until the contrary is shown.

EXPLANATORY NOTE.

The purpose of this Order is to achieve, for national strategic supply reasons, the importation, loading or off-loading and storage of cargoes of crude oil at Whiddy Terminal, Bantry Bay, County Cork.
