PROPOSED MERGER OR TAKE-OVER PROHIBITION ORDER, 1990 (REVOCATION) ORDER, 1990.

The Minister for Industry and Commerce, in exercise of the powers conferred on him by Section 9 of the Mergers, Take-overs and Monopolies (Control) Act, 1978 (No. 17 of 1978), as amended by the Restrictive Practices (Amendment) Act, 1987 (No. 31 of 1987) and by the Industry, Commerce and Tourism (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 41 of 1986 ), hereby makes the following Order:

1. This Order may be cited as the Proposed Merger or Take-over Prohibition Order, 1990 (Revocation) Order, 1990.

2. The Proposed Merger or Take-over Prohibition Order, 1990 ( S.I. No. 42 of 1990 ) is hereby revoked.

3. The reasons for making this Order are that the European Commission has made a decision on the 8th day of May, 1990 under Article 66 of the Treaty establishing the European Coal and Steel Community, signed at Paris on the 18th day of April, 1951, authorising subject to specified requirements, the proposed merger or take-over prohibited by the Order referred to in Article 2 of this Order; the proposed merger or take-over does not contravene Article 86 of the Treaty establishing the European Economic Community signed at Rome on the 25th day of March, 1957; and the Minister for Industry and Commerce considers that the proposed merger or take-over insofar as it relates to products falling under the latter Treaty may proceed.

EXPLANATORY NOTE.

The effect of the Order is to lift the prohibition imposed by the Proposed Merger or Take-over Prohibition Order, 1990 on the proposed merger or take-over involving British Steel plc and C. Walker & Sons (Holdings) Ltd., insofar as it or a subsidiary of, or enterprise controlled by, it carries on business in the State.

The Order is effective from the date of its signature, but may be annulled by a resolution of either House of the Oireachtas within twenty one sitting days in either case.
