S.I. No. 102/1990 - Health (Emulsifiers, Stabilisers, Thicking and Gelling Agents in Food) (Amendment) Regulations, 1990.


In exercise of the powers conferred on the Minister for Health by sections 5 , 54 and 59 of the Health Act, 1947 (No. 28 of 1947), subsection (3) of section 38 of the Health Act, 1953 (No, 26 of 1953) and section 6 of the Health Act, 1970 (No. 1 of 1970 ), which said powers are delegated to me by the Health (Delegation of Functions) Order, 1989 ( S.I. No. 235 of 1989 ), I, NOEL TREACY, Minister of State at the Department of Health, after consultation with the Minister for Industry and Commerce and the Minister for Agriculture and Food hereby make the following Regulations:

1. These Regulations may be cited as the Health (Emulsifiers, Stabilisers, Thickening and Gelling Agents in Food) (Amendment) Regulations, 1990.

2. The Health (Emulsifiers, Stabilisers, Thickening and Gelling Agents in Food ) Regulations, 1980 ( S.I. No. 35 of 1980 ) as amended by the Health (Emulsifiers, Stabilisers, Thickening and Gelling Agents) (Amendment) Regulations, 1982 ( S.I. No. 273 of 1982 ) and the Health (Emulsifiers, Stabilisers, Thickening and Gelling Agents in Food) (Amendment) Regulations, 1985 ( S.I. No. 186 of 1985 ) are hereby further amended by:

( a ) the substitution in Part 1 of Schedule 1 thereto of the following:

"(i) Pectin

E440

(ii) Amidated Pectin

E440"

for

"Pectin

E440A

Amidated Pectin

E440B";

( b ) the deletion in Part 1 of Schedule 1 thereto of the following substances:

Lactylated fatty acid esters of glycerol and propane-1, 2-diol

Polyoxyethylene (8) stearate

Polyoxyethylene (40) stearate

Dioctyl sodium sulphosuccinate;

( c ) the substitution in Part II of Schedule 1 thereto of the words "E440 Pectin" and "E440 Amidated Pectin" for the words "E440(A) Pectin" and "E440(B) Amidated Pectin" respectively; and

( d ) the deletion in Part II of Schedule 1 thereto of the references to and accompanying specific purity criteria for each of the following substances:

Lactylated fatty acid esters of glycerol and propane-1, 2-diol

Polyoxyethylene (8) stearate.

Polyoxyethylene (40) stearate

Dioctyl sodium sulphosuccinate.

EXPLANATORY NOTE.

These Regulations update and further amend the Health (Emulsifiers, Stabilisers, Thickening and Gelling Agents in Food) Regulations, 1980 ( S.I. No. 35 of 1980 ) in order to give effect to EC Council Directives No. 86/102 (OJ No. L088. 3/4/86 P. 40) and 89/393 (O.J NO. L186, 30/6/89 p. 13) relating to emulsifiers, stabilisers, thickeners and gelling agents for use in foodstuffs.
