S.I. No. 189 of 1989.

TELEPHONE (AMENDMENT) SCHEME, 1989.

BORD TELECOM ÉIREANN, in exercise of the powers conferred on it by Section 90, Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Telephone (Amendment) Scheme, 1989.

(2) The collective citation "the Telephone Schemes 1980 to 1989" includes this Scheme.

2. This Scheme shall be deemed to have come into operation on 17 October 1988.

3. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Scheme.

4. The Telephone Regulations, 1980 ( S.I. No. 195 of 1980 ), are hereby amended by:

( a ) the insertion of the following new Regulations after Regulation 20A;

"20B. Bord Telecom Éireann may provide a facility (in these Regulations referred to as "Call Diversion") to subscribers generally or to such groups of subscribers as it shall determine, whereby a subscriber may cause calls to his telephone to be diverted to another telephone in the telephone group of the subscriber. There shall be charged to the subscriber and paid by him in respect of Call Diversion the charges specified in paragraph 9 of Part 1 of the Fifth Schedule to these Regulations.

20C. Bord Telecom Éireann may provide a facility (in these Regulations referred as to "Call Waiting") to subscribers generally or to such groups of subscribers as it shall determine, whereby a call may be interrupted by a message signifying that another call is waiting for the subscriber. There shall be charged to the subscriber and paid by him in respect of Call Waiting the charges specified in paragraph 10 of Part 1 of the Fifth Schedule to these Regulations.

20D. Bord Telecom Éireann may provide a facility (in these Regulations referred to as "Conference Calls") to subscribers generally or to such groups of subscribers as it shall determine, whereby two other subscribers or callers using separate telephones may participate in calls made by the subscriber. There shall be charged to the subscriber and paid by him in respect of Conference Calls the charges specified in paragraph 11 of Part 1 of the Fifth Schedule.

20E. Bord Telecom Éireann may provide a facility (in these Regulations referred to as "Abbreviated Calling") to subscribers generally or to such groups of subscribers as it shall determine, whereby a subscriber may make calls to certain telephones determined by the subscriber through the use of abbreviated dialling. There shall be charged to the subscriber and paid by him in respect of Abbreviated Calling the charges specified in paragraph 12 of Part 1 of the Fifth Schedule to these Regulations.

20F. Bord Telecom Éireann may provide a facility (in these Regulations referred to as "Hotline") to subscribers generally or to such groups of subscribers as it shall determine, whereby a subscriber may cause a call to be made to a telephone, determined by the subscriber in advance, by lifting the handset and not dialling a number within a time to be determined by Bord Telecom Éireann. There shall be charged to the subscriber and paid by him in respect of Hotline the charges specified in paragraph 13 of Part 1 of the Fifth Schedule to these Regulations."; and,

( b ) the substitution of the following Schedule for the Fifth Schedule thereto [inserted by Paragraph 6 (f) of the Telephone (Amendment) (No. 2) Scheme, 1988, ( S.I. No. 256 of 1988 )]:

PART 1.

Charges for Special Services which are payable in addition to the appropriate charges set out in the foregoing Schedules to these Regulations.

1. Personal Call

( a ) Within State and to Northern Ireland Great Britain, the Isle of Man and the Channel Islands.

PART II.

Charges which are payable in lieu of all other charges set out in the foregoing Schedules to these Regulations.

1. Urgent Calls

Double the charges otherwise payable under the Regulations.

2. Cancellation fee for Personal Call

( a ) Within State and to Northern Ireland, Great Britain, the Isle of Man and the Channel Islands.

3. Cancellation Fee for Fixed-time Calls

One quarter of the charge which would be payable if the call had been effected
