S.I. No. 256 of 1988.

TELEPHONE (AMENDMENT) (No. 2) SCHEME, 1988.

BORD TELECOM ÉIREANN, in exercise of the powers conferred on it by Section 90, Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Telephone (Amendment) (No. 2) Scheme, 1988.

(2) The collective citation "the Telephone Schemes 1980 to 1988" includes this Scheme.

2. This Scheme shall come into operation on 1 October, 1988. However, Bord Telecom Éireann may, for operational reasons, postpone in whole or in part the application of this Scheme either generally or in respect of such groups of subscribers or areas of the State as it shall determine.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4. In this Scheme "the Scheme of 1986" means the Telephone (Amendment) Scheme, 1986 ( S.I. No. 78 of 1986 ).

5. The Minister for Communications, pursuant to Section 90 (2) of the Postal and Telecommunications Services Act, 1983 , has concurred in the increase of charges effected by this Scheme.

6. The Telephone Regulations, 1980 ( S.I. No. 195 of 1980 ), are hereby amended by:

(a) The substitution of the following new Regulation for Regulation 9:

"9. (1) In respect of every call made by a subscriber to a telephone in the same telephone group or to a telephone in another telephone group which is regarded by Bord Telecom Éireann as being adjacent to the telephone group of the subscriber making the call or to Eirpage Equipment there shall be charged to the subscriber and paid by him whichever of the charges specified in paragraphs 1 and 3 of the First Schedule to these Regulations is appropriate to the call.

(2) (a) In respect of every call made from a coin-box exchange line to a telephone in the same telephone group or to a telephone in another telephone group which is regarded by Bord Telecom Éireann as being adjacent to the telephone group of the coin-box exchange from which the call is being made or to Eirpage Equipment there shall be placed in the coin-box whichever of the charges specified in paragraphs 2 (a) and 4 (a) of the First Schedule to these Regulations is appropriate to the call.

(b) In respect of every call made by a caller from a call office to a telephone in the same telephone group or to a telephone in another telephone group which is regarded by Bord Telecom Éireann as being adjacent to the telephone group of the call office from which the call is being made or to Eirpage Equipment there shall be charged to the caller and paid by him whichever of the charges specified in paragraph 2 (b) and 4 (b) of the First Schedule to these Regulations is appropriate to the call.";

(b) The substitution of the following Schedule for the First Schedule thereto (inserted by paragraph 6 (a) of the Scheme of 1986):
