KILKENNY APPOINTED STANDS (STREET SERVICE VEHICLES) BYE-LAWS, 1987.

I, LAURENCE WREN, Commissioner of the Garda Siochana, in exercise of the powers conferred on me by section 84 (as amended by section 6 of the Road Traffic Act, 1968 (no. 25 of 1968)) of the Road Traffic Act, 1961 (No. 24 of 1961), the Local Government (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 269 of 1977 ), with the consent of the Minister for the Environment, and after consultation with the Mayor, Aldermen and Burgesses of Kilkenny, hereby make the following bye-laws in respect of the borough of Kilkenny.

1 Short title

1. These bye-laws may be cited as the Kilkenny Appointed Stands (Street Service Vehicles) Bye-laws, 1987.

2 Interpretation

2. In these bye-laws—

"street" means a public road;

reference to the "head of the appointed stand" shall be construed as referring to that end of an appointed stand from which the limits of the appointed stand are reckoned in column (3) of the Schedule.

"Schedule" means the Schedule to these bye-laws.

3 Appointment of appointed stand

3. In the street mentioned in column (2) of the Schedule, the part of the street described in column (3) of the Schedule opposite the mention in column (2) of that street shall be the appointed stand available at which street service vehicles may stand for hire, subject to these bye-laws, for use without limitation as to time or occasion of user.

4 Position of vehicles at appointed stand

4. (1) The following provisions apply to a street service vehicle standing for hire at the appointed stand:

(a) the vehicle shall be placed in the appropriate position specified in column (5) of the Schedule;

(b) the whole of the vehicle shall be inside the limits of the stand specified in column (3) of the Schedule;

(c) the distance from the kerb to the nearest part of the vehicle shall not exceed 18 inches; and

(d) where there is no street service vehicle already at the stand the vehicle shall be placed at the head of the stand, and each vehicle subsequently entering the stand shall, subject to bye-law 6 of these bye-laws, be placed as close as practicable to the street service vehicle at the head of the stand.

(2) A street service vehicle placed at the appointed stand but not complying with paragraph (1) of this bye-law shall be deemed for the purpose of these bye-laws not to be standing for hire at the stand.

5 Maximum number of street service vehicles at appointed stand .

5. Wherever the number of street service vehicles standing for hire at the appointed stand is equal to the number mentioned in column (4) of the Schedule opposite the mention of the appointed stand in column (3) of the Schedule, the driver of a street service vehicle not already so standing for hire shall not place that street service vehicle at that appointed stand.

6 Vacancies at appointed stand

6. Whenever a vacancy occurs at the appointed stand because of the departure from the stand of a street service vehicle, the street service vehicle nearest to the space so vacated shall be moved forward by its driver into that space, and each driver of any other street service vehicle then standing at the appointed stand shall in turn move forward his vehicle into the space nearest to him in the direction of the head of the appointed stand.

7 General provisions relating to appointed stand

7. (1) The following provisions apply in respect of street service vehicles standing for hire at the appointed stand:

(a) a street service vehicle shall not be placed at the appointed stand so that it rests wholly or partly on a footway, or that portion of the vehicle projects over the footway so as to interfere with the free movement of pedestrians on the footway;

(b) a person shall not wash, overhaul or execute repairs to such a street service vehicle, except such repairs as are necessary to enable the vehicle to be removed from the appointed stand;

(c) neither the driver of such a street service vehicle nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings or instruments fitted to or carried on the vehicle or any loudspeaker in or on or in any way connected with the vehicle.

(2) The driver of a street service vehicle which is placed at, being brought into or removed from the appointed stand shall comply with all directions given to him by a member of the Garda Siochana in relation to the placing of the vehicle at the appointed stand or the bringing of the vehicle into, or the removal of the vehicle from, the appointed stand.

8 General restrictions on street service vehicles standing for hire

8. A driver of a street service vehicle shall not stand it for hire in the area comprising the borough of Kilkenny otherwise than at the appointed stand and in accordance with these bye-laws.

EXPLANATORY NOTE.

These bye-laws—

(1) provide a stand for street service vehicles as indicated in the Schedule to these bye-laws;

(2) outline the conditions subject to which street service vehicles may lawfully use the stand, and

(3) prohibit the driver of a street service vehicle from standing the vehicle for hire elsewhere than at the appointed stand in the area comprising the borough of Kilkenny.
