MERCHANDISE MARKS (PREPACKED GOODS) (MARKING AND QUANTITIES) (AMENDMENT) ORDER, 1983.

I, FRANK CLUSKEY, Minister for Trade, Commerce and Tourism, after consultation with such persons as appear to me to be substantially interested in the general subject matter of the Order following and after compliance with subsection (10) of section 2 of the Merchandise Marks Act, 1970 (No. 10 of 1970), hereby, in exercise of the powers conferred on me by the said section 2, as adapted by the Industry, Commerce and Tourism (Alteration of Name of Department and Title of Minister) Order, 1981 ( S.I. No. 290 of 1981 ), order as follows:

1. This Order may be cited as the Merchandise Marks (Prepacked Goods) (Marking and Quantities) (Amendment) Order, 1983.

2. This Order shall come into operation on the 1st day of January, 1984.

3. The Merchandise Marks (Prepacked Goods) (Marking and Quantities) Order, 1973 ( S.I. No. 28 of 1973 ), is hereby amended—

( a ) in Article 8 by the insertion of the following paragraphs after paragraph (3);

"(4) This Order shall not apply in relation to vegetables (other than fresh, frozen or dried vegetables), or fruit (other than dried fruit), packed in containers other than cans.

(5) Article 3 of this Order shall not apply in relation to barley, rice, sago, tapioca, semolina, cornflour, macaroni, spaghetti, vermicelli, noodles or condensed milk, packed in cans.",

( b ) in the First Schedule—

(i) in Part I, by the deletion in column (1) of "(not in cans)", in each place where it occurs,

(ii) in Part II, in column (1), by the deletion of "(not in cans)" and the insertion of "Beer made from malt including ale, porter, lager and stout but excluding acid beer and gueuze", before "Detergent liquids for toiletry use,", and

( c ) in the Second Schedule, by the deletion in Part I of "canned" and "(in cans)", wherever they occur, and "in cans".

4. The said Merchandise Marks (Prepacked Goods) (Marking and Quantities) Order, 1973, shall, insofar as it applies to beer of a kind specified in Part II (as amended by Article 3 of this Order) of the First Schedule thereto, have effect as if the following were substituted for the matter in column (2) of that Schedule:

"190 millilitres

250 millilitres

284 millilitres

330 millilitres

350 millilitres

500 millilitres

568 millilitres

750 millilitres

1 litre

2 litres

3 litres

4 litres

5 litres."

EXPLANATORY NOTE.

This Order amends the Merchandise Marks (Prepacked Goods) (Marking and Quantities) Order, 1973 (as amended) so as to prescribe the sizes in which prepacked beer made from malt, including ale, porter, lager and stout may be sold with effect from 1 January, 1984.
