ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF KILDARE) REGULATIONS, 1983.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Kildare) Regulations, 1983.

2 Commencement.

2. These Regulations shall come into operation on the 5th day of October, 1983.

3 Interpretation.

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"distance" means distance as measured along the centre line of a road;

"national road" means a road declared to be a national road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First and Second Schedules to the aforementioned Order;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles in the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation

7. The Road Traffic (Speed Limits) (County of Kildare) Regulations, 1977 ( S.I. No. 105 of 1977 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Athy:—

( a ) the Ballintubbert Road.

( b ) ``The Stradbally Road for a distance of 50 metres from the urban district boundary.

( c ) National Road N78 for a distance of 91 metres north-eastwards from the urban district boundary.

( d ) The Fortbarrington Road for a distance of 420 metres from the point where the urban district boundary intersects the eastern side of the road.

( e ) The Carlow Road between the urban district boundary and a point 68 metres south of its junction with the Aughaboura Road.

( f ) National Road N78 from the point where the urban district boundary intersects the northern side of the road, westwards to a point 150 metres east of its junction with the Kildare Road.

( g ) The Monasterevan Road for a distance of 160 metres southwards from the point where the urban district boundary intersects the eastern side of the road.

2. The following roads in the town of Droichead Nua:—

( a ) The Milltown or Station Road for a distance of 146 metres from the town boundary.

( b ) The Morristownbiller Road for a distance of 30 metres from the town boundary at the Railway Bridge.

3. The following roads in the Urban District of Naas:—

( a ) The Monread Road, Fishery Lane, Tipper Road North, Tipper Road South.

( b ) The Sallins Road for a distance of 700 metres from the urban district boundary.

( c ) Mill Lane between the urban district boundary and a point 65 metres west of its junction with the Sallins Road.

( d ) Canal Bank between the urban district boundary and a point 100 metres north of its junction with the Abbey Bridge Road.

( e ) The Caragh Road between the urban district boundary and a point 430 metres west of the centre line of Ploopluck Bridge.

( f ) National Road N7 from the urban district boundary north-eastwards to a point 90 metres south-west of its junction with St. David's Terrace.

( g ) The Rathasker Road for a distance of 1,120 metres from the urban district boundary.

( h ) National Road N9 for a distance of 880 metres from the urban district boundary.

( i ) The Ballymore Eustace Road for a distance of 1,216 metres from the urban district boundary.

( j ) The Craddockstown Road between the urban district boundary and a point 330 metres south-east of the centre line of the railway bridge.

( k ) The Blessington Road between the urban district boundary and a point 160 metres south-east of its junction with the Friary Road.

( l ) The road leading from the Rathasker Road to the Kilcullen Road between the townlands of Bluebell and Rathasker.

( m ) The Tipper Road for a distance of 100 metres from its junction with the Tipper Road North and the Tipper Road South.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following road adjacent to the Urban District of Athy:—

The Kildare Road for a distance of 275 metres from the boundary of the urban district of Athy.

2. The following roads at Ballitore:—

( a ) Market Square.

( b ) Abbeys Row between its junction with Market Square and a point 50 metres south-east of its junction with the Athy Road.

( c ) The Barracks Road between its junction with Market Square and a point 320 metres north-west of its junction with the Naas-Carlow road.

( d ) The Fullers Court Road between its junction with Market Square and a point 490 metres south-east of the southern edge of the said square.

3. The following roads at Ballymore Eustace:—

( a ) Oliver Plunkett Road, Market Square, Chapel Street, St. Brigid's Terrace, Assumpta Terrace.

( b ) The Naas Road between its junction with Market Square and a point 120 metres north of its junction with the Stonebrook Road.

( c ) The Stonebrook Road for a distance of 55 metres from its junction with the Naas Road.

( d ) The Ardinode Road for a distance of 90 metres from its junction with the Hollywood Road.

( e ) Main Street and its continuation as the Hollywood Road to a point 370 metres south of its junction with the Ardinode Road.

( f ) The Tipperkevin Road for a distance of 275 metres from its junction with Market Square.

( g ) The Bishopshill Road for a distance of 245 metres from its junction with the Poulaphuca Road.

( h ) The Poulaphuca Road between its junction with Market Square and a point 320 metres east of its junction with the Bishopshill Road.

4. The following roads at Castledermot:—

( a ) Carlow Gate, School Lane, The Square, William Pearse Terrace, The Abbeylands Housing Estate roads, the Deals, Ivers Lane.

( b ) National Road N9 between a point 5 metres south of the Pike Cross and a point 90 metres south-west of its junction with the Tullow Road.

( c ) Church Lane between its junction with National Road N9 and a point 80 metres south of its junction with Ivers Lane.

( d ) The Tullow Road for a distance of 23 metres from its junction with National Road N9.

( e ) The Newtownallen Road between the Square and a point 65 metres west of its junction with the Athy Road.

( f ) The Athy Road between the Square and a point 46 metres north-west of its junction with Carlow Gate.

( b ) The Clane Road for a distance of 23 metres from its junction with Tee Lane.

( c ) The Templemills Road for a distance of 310 metres from its junction with the Hazelhatch Road.

( d ) The Hazelhatch Road for a distance of 750 metres from its junction with the Lucan Road.

( e ) Tee Lane and its continuation as the Oldtown Road to a point 500 metres north-west of the westernmost entrance to St. Patrick's Park.

( f ) The Lucan Road between its junction with Main Street and a point 185 metres north-east of the centre line of Liffey Bridge.

( g ) The Maynooth Road for a distance of 840 metres from its junction with Main Street.

6. The following roads at Clane:—

( a ) Capdoo Lane.

( b ) The Naas-Kilcock road between a point 35 metres north of its junction with the northernmost entrance to Loughbollard housing estate and a point 130 metres south of the centre line of Alexandra Bridge.

( c ) The Dublin Road between its junction with the Naas-Kilcock road and a point 220 metres north-east of its junction with Capdoo Lane.

( d ) Doctor's Lane for a distance of 245 metres from its junction with the Naas-Kilcock road.

( e ) The Prosperous Road for a distance of 1,270 metres from its junction with the Naas-Kilcock road.

7. The following roads at Coill Dubh:—

( a ) Bord na Móna housing estate roads.

( b ) The Blackwood-Timahoe road between a point 410 metres north-west of its junction with the Brockagh Road and a point 45 metres east of the said junction.

( c ) The Brockagh Road for a distance of 260 metres from its junction with the Blackwood-Timahoe road.

8. The following road at Curragh Camp:—

The Ballymany Cross-Brownstown road between a point 70 metres north-west of its junction with Collins Road West and a point 485 metres south-west of its junction with O'Higgins Road West.

9. The following roads adjacent to the town of Droichead Nua:—

( a ) Moore Park, Moorefield Crescent, The Ballymany Park Roads, Roseberry Commons, Industrial Estate Road, The Common Road.

( b ) The Barrettstown Road between the boundary of the town of Droichead Nua and a point 550 metres north-east of its junction with Mooney's Road.

( c ) Mooney's Road for a distance of 150 metres from its junction with the Barrettstown Road.

( d ) Sex Road between its junction with the Barrettstown Road and a point 150 metres east of the centre line of Sex Bridge.

( e ) The Standhouse Road between the point where the boundary of the town of Droichead Nua intersects the southern side of the road and a point 130 metres west of its junction with Blackberry Lane.

( c ) The Westown Road for a distance of 275 metres from its junction with the main road through Johnstown village.

11. The following roads at Kilcock:—

( a ) Canal Street, Cemetery Lane, Luby's Lane, Mill Lane, School Street, The Square, Fair Green, New Lane, New Road, The Crescent, Highfield Park.

( b ) National Road N4 between a point 660 metres northwest of its junction with the Naas Road and a point 320 metres south-east of the said junction.

( c ) The Naas Road between its junction with National Road N4 and a point 120 metres north-east of the centre line of Courtown Bridge.

( d ) The Branganstown (Rathcoffey) Road for a distance of 395 metres from its junction with the Naas Road.

( e ) The Dunshaughlin Road between its junction with the Square and the boundary between the counties of Meath and Kildare.

12. The following roads at Kilcullen:—

( a ) The Square, St. Brigid's Park, Conroy Park, Nicholastown housing estate roads.

( b ) National Road N9 between a point 50 metres south of the southernmost entrance road to Nicholastown housing estate and a point 20 metres north of its junction with the Logstown Road.

( c ) The Dunlavin Road for a distance of 185 metres from its junction with National Road N9.

( d ) The Logstown Road for a distance of 200 metres from its junction with National Road N9.

( e ) The Droichead Nua Road for a distance of 570 metres from its junction with National Road N9.

13. The following roads at Kildare:—

All roads in the area enclosed by a line commencing at a point on the Milltown Road 366 metres north of its junction with the Melitta Road and drawn thence in straight lines successively to the following points:—

( a ) a point on the Rathangan (via Dunmurry) Road 20 metres north of its junction with the Fair Green Cottages Road.

( b ) a point on the Old Road 46 metres north of its junction with Bohereenagerr.

( c ) a point on the Redhills Road 65 metres north-west of its junction with Pigeon Lane.

( d ) a point on the South Green Road 45 metres north-west of its junction with Bohereenagerr.

( e ) a point on National Road N7 90 metres west of its junction with Pigeon Lane,

( f ) a point on the Athy Road 320 metres south of its junction with St. Brigid's Square,

( g ) a point on the Tully Road 200 metres south of its junction with the Convent Road,

( d ) The Hartwell Road for a distance of 590 metres from its junction with the main road through Kill Village.

15. The following roads at Leixlip:—

( b ) The Clane-Allenwood road between a point 90 metres west of its junction with the Robertstown Road and a point 90 metres east of its junction with the Staplestown Road.

( c ) The Robertstown Road from a distance of 120 metres from its junction with the Clane-Allenwood road.

( d ) The Staplestown Road between its junction with the Clane-Allenwood road and a point 275 metres north-west of its junction with the Maynooth Road.

( e ) The Maynooth Road for a distance of 335 metres from its junction with the Staplestown Road.

21. The following roads at Sallins:—

( a ) Chapel Lane, Chapel Avenue, St. Brigid's Terrace housing estate roads.

( b ) The Naas-Clane road between a point 715 metres north of its northernmost entrance road to St. Brigid's Terrace housing estate and a point 140 metres south of the centre line of the Railway Bridge.

( c ) North Canal View and its continuation as the Straffan Road between its junction with the Naas-Clane road and a point 35 metres east of its junction with Chapel Lane.

( d ) South Canal View and its continuation as the Kerdiffstown Road for a distance of 310 metres from its junction with the Clane-Naas road.

( e ) The road connecting the Naas-Clane road with North Canal View.

( f ) The road connecting the Naas-Clane road with South Canal View.

22. The following roads at Suncroft:—

( a ) The Curragh-Athy road between a point 90 metres south-west of its junction with Askinrow Lane and a point 900 metres north-east of the said junction.

( b ) Askinrow Lane for a distance of 305 metres from its junction with the Curragh-Athy road.

23. The following roads adjacent to the Urban District of Naas:—

( a ) The Dublin-bound carriageway of National Road N7 for a distance of 670 metres from the boundary of the Urban District of Naas at Monread.

( b ) The Naas bound exit carriageway from the Naas By-Pass between its junction with the Dublin-bound carriageway of the Naas By-Pass and its junction with the Naas-bound carriageway of National Road N7 at Monread.

( c ) The Naas-bound carriageway of National road N7 between the boundary of the Urban District of Naas and a point 10 metres north-east of its junction with the Naas-bound exit carriageway from the Naas By-Pass at Monread.

( d ) The entry carriageway to the Naas By-Pass for a distance of 270 metres from the boundary of the Urban District of Naas at Monread.

THIRD SCHEDULE.

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Allenwood:—

( a ) The Edenderry-Clane road between a point 90 metres east of its junction with the Littletown Road and a point 320 metres west of the said junction.

( b ) The Power Station Road for a distance of 60 metres from its junction with the Edenderry-Clane road.

( c ) The Littletown Road for a distance of 185 metres from its junction with the Edenderry-Clane road.

2. The following roads in and adjacent to the Urban District of Athy:—

( a ) The Carlow Road between a point 68 metres south of its junction with the Aughaboura Road and a point 570 metres south of the said junction.

( b ) National Road N78 between a point 150 metres east of its junction with the Kildare Road and a point 425 metres north-east of its junction with the Castledermot Road.

3. The following roads at Celbridge:—

( a ) The Maynooth Road between a point 840 metres north-west of its junction with Main Street and a point 1,160 metres north-west of the said junction.

( b ) The Clane Road between a point 23 metres south-west of its junction with Tee Lane and a point 320 metres south-west of the said junction.

4. The following roads at Derrinturn:—

( a ) The Dublin-Edenderry road between a point 410 metres south-east of its junction with the Ballyshannon Road and a point 615 metres north-west of the said junction.

( b ) The Ballyshannon Road for a distance of 425 metres from its junction with the Dublin-Edenderry road.

5. The following roads at Johnstown Bridge:—

( a ) The Innfield (Enfield)-Carbury road between a point 35 metres south-west of the boundary between the counties of Meath and Kildare and a point 35 metres south-west of its junction with the Kilmore Road.

( b ) The Kilmore Road for a distance of 130 metres from its junction with the Innfield (Enfield)-Carbury road.

( c ) The Donadea Road for a distance of 90 metres from its junction with the Innfield (Enfield)-Carbury road.

6. The following roads at Kilcock:—

( a ) National Road N4 between a point 660 metres north-west of its junction with the Naas Road and a point 90 metres west of the centre line of Spin Bridge.

( b ) The Navan Road for a distance of 35 metres from its junction with National Road N4.

( c ) National Road N4 between a point 320 metres south-east of its junction with the Naas Road and a point 550 metres south-east of the said junction.

7. The following roads at Kilcullen:—

( a ) Moanbane housing estate roads, Bishop Rogan Park housing estate roads.

( b ) National Road N9 between a point 20 metres north of its junction with the Logstown Road and a point 20 metres north of the entrance road to Moanbane housing estate.

8. The following roads at Kildare:—

( a ) National Road N7 between a point 230 metres north-east of its junction with the Frenchfurze Road and a point 780 metres north-east of the said junction.

( b ) National Road N7 between a point 90 metres west of its junction with Pigeon Lane and a point 320 metres west of the said junction.

9. The following roads at Leixlip:—

( a ) National Road N4 between a point 65 metres north-west of its junction with Old Green Lane and a point 65 metres west of the centre line of Louisa Bridge.

( b ) New Green Lane for a distance of 25 metres from its junction with National Road N4 at Louisa Bridge.

10. The following roads at Maynooth:—

( a ) The Moyglare Road between a point 475 metres north-west of its junction with National Road N4 and a point 925 metres north-west of the said junction.

( b ) The Clane Road between a point 265 metres south-west of its junction with the Ballygoran Road and a point 920 metres south-west of the said junction.

11. The following roads at Milltown:—

( a ) The Newbridge Road between a point 300 metres north-west of its junction with the Kildare Road and a point 615 metres southeast of the said junction.

( b ) The Kildare Road for a distance of 450 metres from its junction with the Newbridge Road.

12. The following roads at Monasterevan:—

( a ) Ballyfarsoon Lane.

( b ) National Road N7 between a point 183 metres south-east of its junction with Drogheda Street and a point 75 metres north-east of Turnpike cross roads.

( c ) National Road N7 between a point 160 metres south-west of the centre line of Towns Bridge and a point 230 metres north-east of the centre line of Clogheen Canal Bridge.

( d ) The Cowpasture Road between its junction with National Road N7 and a point 412 metres south-east of its junction with Drogheda Row.

National Road N7 from a point 90 metres south-west of its junction with St. David's Terrace, south-westwards to a point 1,205 metres north-east of the urban district boundary.

14. The following roads at Rathangan:—

( a ) The Kildare Road between a point 300 metres south-east of its junction with the Monasterevan Road and a point 975 metres south-east of the said junction.

( b ) The Sheane Road between a point 25 metres west of its junction with the Annsboro Road and a point 70 metres north-east of the boundary between the counties of Offaly and Kildare.

15. The following roads at Straffan:—

( a ) The Kill-Maynooth road between a point 130 metres north of its junction with the Clane-Celbridge road and a point 75 metres south of its junction with the Bohereen Road.

( b ) The Clane-Celbridge road between a point 190 metres east of its junction with the Kill-Maynooth road and a point 455 metres north-west of the said junction.

( c ) The Bohereen Road for a distance of 75 metres from its junction with the Kill-Maynooth road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Kildare) Regulations, 1977 ( S.I. No. 105 of 1977 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
