RESTRICTIVE PRACTICES (MOTOR SPIRIT) ORDER, 1978.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 8 (2) of the Restrictive Practices Act, 1972 (No. 11 of 1972), and the Industry and Commerce (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 306 of 1977 ), hereby order as follows:

1. This Order may be cited as the Restrictive Practices (Motor Spirit) Order, 1978.

2. The Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1975, and this Order may be cited together as the Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1978.

3. The Restrictive Trade Practices (Motor Spirit) Order, 1972 ( S.I. No. 150 of 1972 ), is hereby amended by the substitution in Article 3 (1) for "six years" (inserted by the Restrictive Practices (Motor Spirit) Order, 1975 ( S.I. No. 121 of 1975 )) of "seven years", and the said Article 3 (1), as so amended, is set out in the Table to this Article.

TABLE.

(1) Subject to the provisions of this Article, during the period of seven years from the commencement of this Order, a person shall not operate as a company station a motor spirit station that was not operated as a company station immediately before such commencement.

EXPLANATORY NOTE.

The effect of this Order is to extend for a period of one year the provision in the Restrictive Trade Practices (Motor Spirit) Order, 1972, as amended by the Restrictive Practices (Motor Spirit) Order, 1975, which prohibited petrol companies from operating additional retail outlets.
