RESTRICTIVE PRACTICES (MOTOR SPIRIT) ORDER, 1975.

I, JUSTIN KEATING, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 8 (2) of the Restrictive Practices Act, 1972 (No. 11 of 1972), hereby order as follows:

1. This Order may be cited as the Restrictive Practices (Motor Spirit) Order, 1975.

2. This Order and the Restrictive Trade Practices (Motor Spirit and Motor Vehicle Lublicating Oil) Orders, 1961 to 1972, may be cited together as the Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1975, and shall be construed together as one.

3. Article 3 of the Restrictive Trade Practices (Motor Spirit) Order, 1972 ( S.I. No. 150 of 1972 ), is hereby amended by—

( a ) the substitution of "six" for "three" in paragraph (1),

( b ) the substitution of "three miles" for "one mile" in paragraph (3) (d), and

( c ) the substitution of "three miles" for "one mile" in paragraph (4) (c),

and the said paragraph (1), subparagraph (d) of paragraph (3) and subparagraph (c) of paragraph (4), as so amended, are set out in the Table to this Article.

TABLE.

(1) Subject to the provisions of this Article, during the period of six years from the commencement of this Order, a person shall not operate as a company station a motor spirit station that was not operated as a company station immediately before such commencement.

( d ) after such closure but not later than two years after the said completion, the operation of another motor spirit station as a company station is commenced at a place not more than three miles from the place where the station aforesaid was situate by the person who operated it immediately before its closure,

( c ) not later than one year after such closure the operation of another motor spirit station as a company station is commenced at a place not more than three miles from the place where the station aforesaid was situate by the person who operated it immediately before its closure.

EXPLANATORY NOTE.

The effect of this Order is to extend for a period of three years the prohibition on the operation by petrol suppliers of additional retail outlets and also to make some other amendments of the Restrictive Trade Practices (Motor Spirit) Order, 1972. The Order requires to be confirmed by an Act of the Oireachtas before it will have the force of law.
