ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF WICKLOW) REGULATIONS, 1978.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits)

(County of Wicklow) Regulations, 1978.

2 Commencement.

2. These Regulations shall come into operation on the 20th day of February, 1978.

3 Interpretation.

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limits" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of the road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. (1) Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

(2) Fifty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Fourth Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. The Road Traffic (Speed Limits) (County of Wicklow) Regulations, 1968 ( S.I. No. 212 of 1968 ) and the Road Traffic (Speed Limits) (County of Wicklow) (Amendment) Regulations, 1974 ( S.I. No. 263 of 1974 ) are hereby revoked.

FIRST SCHEDULE.

Roads in the County of Wicklow declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Arklow:—

( a ) Ballyraine Hill.

( b ) The Wexford Road between the urban district boundary and a point 347 metres north of the said boundary.

( c ) The Coolgreaney Road for a distance of 265 metres from the urban district boundary.

( d ) The Woodenbridge Road for a distance of 796 metres from the urban district boundary.

2. The following road in the Urban District of Bray:—

The Upper Dargle or Wexford Road between the urban district boundary and a point 9 metres south-west of its junction with the Lower Dargle Road.

3. The following roads in the Urban District of Wicklow:—

( a ) The Bollarney or Rathnew main road for a distance of 275 metres from the urban district boundary.

( b ) The Back Road to Rathnew via Broomhall for a distance of 520 metres from the point where the urban district boundary intersects the northern side of the road.

( c ) The Marlton Road between the urban district boundary and a point 155 metres from its junction with the Bollarney or Rathnew main road.

( d ) The Greenhill Road between the urban district boundary and a point 165 metres south-east of its junction with the Convent Road.

( e ) The Dunbur or Silver Strand Road for a distance of 347 metres from the urban district boundary.

SECOND SCHEDULE.

Roads in the County of Wicklow declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following road adjacent to the Urban District of Arklow:—

The Dublin Road where the said road is a perimeter road.

2. The following roads at Aughrim:—

( a ) The Station Road, Chapel or Mill Lane.

( b ) The Rathdrum Road between Aughrim Three Roads and a point 155 metres south-east of Tinnakilly Bridge.

( c ) The Tinahely Road for a distance of 210 metres from Aughrim Three Roads.

( d ) The Rednagh Road for a distance of 820 metres from Aughrim Three Roads.

( e ) The Macreddin or Barrack Road between its junction with the Rathdrum Road and its junction with Chapel or Mill Lane.

3. The following roads at Baltinglass:—

( a ) Church Lane, Market Square, Parkmore Cottages Roads.

( b ) The Dublin-Tullow road between a point 348 metres north of its junction with Belan Street and a point 275 metres south of the said junction.

( c ) Belan Street for a distance of 302 metres from its junction with the Dublin-Tullow road.

( d ) The Ballytore Road for a distance of 28 metres from its junction with Belan Street.

( e ) Main Street and the road connecting it with the Dublin - Tullow road.

( f ) Chapel Hill and its continuation as the Sruhaun Road for a distance of 1176 metres from its junction with Weavers Square.

( g ) Weavers Square and its continuation as the Kiltegan Road for a distance of 887 metres from the junction of Weavers Square with Chapel Hill.

4. The following roads at Blessington:—

( a ) The New Cottages Road, Rocky Pool Villas, the Old Road to Blessington Bridge or Millbank.

( b ) The Dublin Baltinglass road between a point 935 metres north-east of its junction with the Kilbride Road and a point 366 metres south-west of the said junction.

( c ) The Kilbride Road for a distance of 395 metres from its junction with the Dublin-Baltinglass road.

( d ) The Naas Road for a distance of 350 metres from its junction with the Dublin-Baltinglass road.

( e ) The Burgage Road for a distance of 230 metres from its junction with the Dublin-Baltinglass road.

( f ) The road leading in a westerly direction from the Dublin-Baltinglass road at a point 320 metres north-east of the junction of the Dublin-Baltinglass road with the Kilbride Road.

5. The following roads adjacent to the Urban District of Bray:—

All roads in the area which lies between the boundary of the urban district of Bray and a line drawn as follows:—

Starting at a point where the boundary of the urban district of Bray intersects the western side of the Herbert Road and thence in a south-westerly direction along the said western edge to a point 1075 metres south-west of the point where the boundary of the urban district of Bray intersects the western side of Herbert Road, thence in a straight line to a point on the Killarney Road 470 metres south-west of its junction with Boghall Road, thence in a straight line to a point where the boundaries of the townlands of Irishtown, Oldcourt and Kilruddery Demesne west meet, there is a straight line to a point on the eastern edge of the Vevay or Greystones Road 140 metres from the boundary of the urban district of Bray, and thence along the said eastern edge to a point where the urban district boundary of Bray intersect the eastern side of the Vevay or Greystones Road.

6. The following roads at Carnew:—

( a ) The Shillelagh-Carnew-Gorey road between a point 366 metres north-west of its junction with Coolattin Row and a point 69 metres south-west of its junction with the Aughrim Road.

( b ) Coolattin Row for a distance of 275 metres from its junction with the Shillelagh-Carnew-Gorey road.

( c ) The road leading eastwards from Coolattin Row at a point approximately 201 metres from the junction of Coolattin Row with the Shillelagh-Carnew-Gorey road.

( d ) Mill Lane for a distance of 201 metres from its junction with the Shillelagh-Carnew-Gorey road.

7. The following roads at Dunlavin:—

( a ) Main Street, Fair Green, Stephen Street, Market Square, Church Terrace.

( b ) Kilcullen Street and its continuation as the Naas Road, from its junction with Market Square to a point 170 metres north-east of its junction with the Lugnatrina Road.

( c ) Holywood Road for a distance of 55 metres from its junction with the Naas Road.

( d ) Lugnatrina Road for a distance of 120 metres from its junction with Kilcullen Street.

( e ) Church Road and its continuation as the Grange Con Road between its junction with Stephen Street and a point 145 metres south-west of its junction with Milltown Road.

( f ) Sparrow Road for a distance of 201 metres from its junction with Stephen Street.

( g ) The Baltinglass Road for a distance of 297 metres from its junction with Stephen Street.

8. The following roads at Enniskerry:—

( a ) All roads (except that section of the main Dublin road north of a point 250 metres north of the centre line of Knocksink Bridge) in the area enclosed by a line commencing at a point on Monastery Road 50 metres north of its junction with the Ballyman Road and drawn thence in straight lines successively to the following points:

(i) a point on the Ballyman Road 50 metres east of its junction with Monastery Road,

(ii) a point on the Bray Road 272 metres east of its junction with the Monastery Road,

(iii) a point on the Roundwood Road 50 metres south of its junction with the Cookstown road,

(iv) a point on the Glencree road 950 metres west of its junction with the Dublin road,

and from the last mentioned point in a straight line to the commencement point on Monastery Road.

( b ) The Glencree Road between a point 950 metres west of its junction with the Dublin Road and a point 1320 metres west of the said junction.

( c ) Roads in the Kilgarron Housing Estate.

9. The following roads at Greystones and Delgany:—

All roads (other than the Greystones-Killincarrig road between a point 170 metres south of its junction with Killincarrick Road and a point 300 metres south-east of its junction with the Kilcoole road) which lie in the area enclosed by a line commencing at the point where the boundary between the townlands of Rathdown Upper and Rathdown Lower meets the High Water Mark and drawn thence in a general southerly direction along the High Water Mark to a point where the said Mark meets the boundary between the townlands of Killincarrig and Ballynerrin and thence in a straight line successively to the following points:—

( a ) a point on the Killincarrig-Kilcoole road 180 metres north of this junction with the road leading westward at Prettybush,

( b ) a point on the Delgany-Glen O'Downs road 180 metres west of its junction with the Bellevue road,

( c ) a point on the Delgany-Bellevue road 800 metres north of its junction with the Delgany-Glenn O'Downs road.

( d ) a point on the Greystones-Bray road 20 metres south of its junction with the road leading westward at Templecarrig Lower,

and from the last mentioned point in a straight line to the commencement point.

10. The following roads at Kilcoole:—

( a ) Monteith Park Housing Estate roads, Sylvan Lawn Housing Estate Roads, Hazlewood Crescent Housing Estate Roads, Beechwood Park Housing Estate Roads.

( b ) The Greystones-Wicklow road between a point 75 metres north of its junction with Lotts Lane and a point 235 metres south of its junction with the Kilcoole Station Road.

( c ) The Newtownmountkennedy Road for a distance of 200 metres from its junction with the Greystones-Wicklow road.

11. The following roads at Laragh:—

( a ) Chapel Road.

( b ) The Annamoe-Glendalough Road between a point 180 metres east of its junction with Glenmacnass Road and a point 700 metres west of the said junction.

( c ) The Glenmacnass Road for a distance of 165 metres from its junction with the Annamoe-Glendalough Road.

( d ) The Rathdrum Road for a distance of 155 metres from its junction with the Annamoe-Glendalough Road.

12. The following roads at Newcastle:—

( a ) The Greystones-Wicklow road between a point 425 metres south of its junction with the Sea Road and a point 380 metres north-west of the said junction.

( b ) The Newcastle Hospital Road for a distance of 640 metres from its junction with the Greystones-Wicklow road.

13. The following roads at Rathdrum:

( a ) Gilbert Row, Sunny Terrace, Back Lane, Brewery Lane, Ballygannon Housing Estate Roads, Parnell Housing Estate Roads.

( b ) Main Street and its continuation as Lower Main Street between a point 23 metres north-west of its junction with the Rathnew-Avoca road and a point 400 metres north-east of its junction with the Glendalough Road.

( c ) The Glendalough Road for a distance of 275 metres from its junction with Main Street.

( d ) Fair Green between its junction with Gilbert Row and its junction with the Greenane and Ballinderry Roads.

( e ) The Greenane Road for a distance of 860 metres west of its junction with the Ballinderry Road.

( f ) The Ballinderry Road for a distance of 780 metres north-west of its junction with the Greenane Road.

14. The following roads at Rathnew:—

All roads in the area enclosed by a line commencing at a point on the Newtownmountkennedy-Rathdrum road 330 metres north-west of its junction with the Wicklow Road and drawn thence in straight lines successively to the following points:—

( a ) a point on the Greystones Road 60 metres north-east of its junction with the Newtownmountkennedy-Rathdrum road.

( b ) a point on the Wicklow road 391 metres south-east of its junction with the Newtownmountkennedy road,

( c ) a point on the Back Road to Wicklow via Broomhall 475 metres south-east of the centre line of the railway bridge at Marrymeeting.

( d ) a point on the Arklow Road 384 metres south of its junction with the Newtownmountkennedy-Rathdrum road.

( e ) a point on the Newtownmountkennedy-Rathdrum road 210 metres west of its junction with the Arklow Road.

and from the last mentioned point in a straight line to the commencement point on the Newtownmountkennedy-Rathdrum road 330 metres north-west of its junction with the Wicklow Road.

15. The following roads at Roundwood:—

( a ) The Laragh-Bray road between a point 60 metres north-east of its junction with the Sally Gap Road and a point 300 metres south-west of its junction with the Rathdrum or Wicklow Road.

( b ) The Rathdrum or Wicklow Road for a distance of 180 metres from its junction with the Laragh-Bray road.

( c ) The Newtownmountkennedy Road for a distance of 180 metres from its junction with the Laragh-Bray road.

( d ) The Lough Dan road for a distance of 165 metres from its junction with the Laragh-Bray road.

16. The following roads at Shillelagh:—

( a ) Church Lane.

( b ) The Tullow-Carnew road between its intersection by the common boundary of the townlands of Ballard and Ballynultagh and a point 28 metres east of its junction with Quarry Street.

( c ) The Clonegal Road for a distance of 220 metres from its junction with the Tullow-Carnew road.

( d ) Quarry Street for a distance of 860 metres from its junction with the Tullow-Carnew road.

17. The following roads at Tinahely:—

( a ) Market or Dwyer Square, Bridge Street.

( b ) Barton Street and its continuation as the Shillelagh Road for a distance of 256 metres from the junction of Barton Street with Market or Dwyer Square.

( c ) Kevin or Main Street and its continuation as the Hacketstown Road for a distance of 640 metres from the junction of Kevin or Main Street with Market or Dwyer Square.

( d ) The New Aughrim Road for a distance of 64 metres from its junction with Bridge Street.

( e ) The Old Aughrim Road for a distance of 55 metres from its junction with Bridge Street.

18. The following roads adjacent to the Urban District of Wicklow:—

( a ) St. Patrick's Road.

( b ) The Ballinabarney or Rocky Road for a distance of 80 metres south-west of the boundary of the urban district of Wicklow.

( c ) Mount Carmel Road and its continuation as the Ballynerrin Road between the boundary of the urban district of Wicklow and a point 70 metres south-west of its junction with St. Patrick's Road.

THIRD SCHEDULE.

Roads in the County of Wicklow in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following road adjacent to the Urban District of Arklow:—

The Dublin Road between the point where the boundary of the urban district of Arklow intersects the eastern side of the road and a point 240 metres north-east of the said point.

2. The following roads at Ashford:—

( a ) The Dublin-Wicklow road between a point 238 metres north of its junction with the Roundwood Road and a point 90 metres south-east of its junction with the Ballinalea Road at Rosanna.

( b ) The Roundwood Road from its junction with the Dublin-Wicklow Road to a point 50 metres north of its junction with the Glendalough Road.

( c ) The Glendalough Road for a distance of 50 metres from its junction with the Roundwood Road.

( d ) The Glenealy Road between its junction with the Dublin-Wicklow road and a point 180 metres south-west of its junction with the Ballinalea-Rosanna road.

( e ) The Ballinalea-Rosanna road, connecting the Dublin-Wicklow road to the Glenealy Road.

3. The following road at Baltinglass:—

The Tullow Road between a point 275 metres south of its junction with Belan Street and a point 70 metres north-east of its junction with the Carlow Road at Bawnoge.

4. The following road in and adjacent to the Urban District of Bray:—

The Upper Dargle or Wexford Road between a point 9 metres south-west of its junction with the Lower Dargle Road and a point 310 metres south-west of the boundary of the urban district of Bray.

5. The following roads at Carnew:—

( a ) The Terrace.

( b ) The Shillelagh-Carnew-Gorey road between a point 69 metres south-west of its junction with the Aughrim Road and a point 293 metres east of the said junction.

( c ) The Aughrim Road for a distance of 110 metres from its junction with the Shillelagh-Carnew-Gorey road.

6. The following roads at Glenealy:—

( a ) The Rathnew-Rathdrum road between a point 400 metres north-east of its junction with the Ashford Road and a point 765 metres south-west of the said junction.

( b ) The Ashford Road for a distance of 300 metres from its junction with the Rathnew-Rathdrum road.

7. The following roads at Greystones and Delgany:—

( a ) The Greystones-Killincarrig road between a point 170 metres south of its junction with Killincarrick Road and a point 595 metres south-west of the said junction.

( b ) The Greystones-Bray road between a point 20 metres south of its junction with the road leading westwards at Templecarrig Lower and a point 390 metres north of the said junction.

8. The following roads at Kilmacanogue:—

( a ) The Dublin-Wexford road between a point 330 metres north-west of its junction with the Rocky Valley Road and a point 330 metres south-east of the said junction.

( b ) The Rocky Valley Road for a distance of 288 metres from its junction with the Dublin-Wexford road.

9. The following roads at Newtownmountkennedy:—

( a ) The Dublin-Wicklow road between a point 880 metres north of its junction with the Kilcoole Road and a point 380 metres south of the said junction.

( b ) Church Road for a distance of 400 metres from its junction with the Dublin-Wicklow road.

( c ) The Roundwood road between its junction with the Dublin-Wicklow road at the Church and a point 70 metres south-west of its junction with the Moneycarroll Road.

( d ) The Moneycarroll Road between its junction with the Roundwood Road and the Dublin-Wicklow road.

( e ) Roads in O'Neill Park Housing Scheme, School Road.

( f ) The Kilcoole Road for a distance of 180 metres from its junction with the Dublin-Wicklow road.

FOURTH SCHEDULE.

Roads in the County of Wicklow in respect of which a special speed limit of 50 miles per hour is prescribed.

1. The following road at Newtownmountkennedy:—

The Wicklow Road between a point 380 metres south of its junction with the Kilcoole Road and a point 13 metres north-west of its junction with the Newcastle Road.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Wicklow) Regulations, 1968 ( S.I. No. 212 of 1968 ) and the Road Traffic (Speed Limits) (County of Wicklow) (Amendment) Regulations, 1974 ( S.I. No. 263 of 1974 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to the subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule and a speed limit of 50 miles per hour in respect of the public roads mentioned in the Fourth Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excluded from all speed limits by the Regulations.
