ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF DONEGAL) REGULATIONS, 1977.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Donegal) Regulations, 1977.

2 Commencement.

2. These Regulations shall come into operation on the 22nd day of August, 1977.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"The Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. The Road Traffic (Speed Limits) (County of Donegal) Regulations, 1968 ( S.I. No. 73 of 1968 ) and the Road Traffic (Speed Limits) (County of Donegal) (Amendment) Regulations, 1971 ( S.I. No. 263 of 1971 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Ballyshannon:—

( a ) The Old Kinlough Road.

( b ) The Rossnowlagh Road for a distance of 411 metres from the town boundary.

( c ) The Knather Road for a distance of 758 metres from the point where the town boundary intersects the southern side of the road.

( d ) The Belleek Road for a distance of 594 metres from the town boundary.

( e ) The Station Road for a distance of 36 metres from the point where the town boundary intersects the north-eastern side of the road.

( f ) The Rock Road for a distance of 374 metres from the town boundary.

( g ) The Sligo Road between the point where the town boundary intersects the northern side of the road and a point 220 metres west of its junction with Westport Road.

2. The following roads in the Urban District of Buncrana: —

All roads in the urban district of Buncrana other than those in the area enclosed by a line commencing at a point on the urban district boundary at the Black Rock in the townland of Ballymacarry Lower and drawn thence in straight lines successively to the following points:—

( a ) a point on the eastern edge of the Bridgend Road 842 metres north-west of the urban district boundary,

( b ) a point on Maginn Avenue 384 metres east of its junction with Lower Main Street,

( c ) a point on the Lisona Road 30 metres south-west of its junction with the Cassy Road,

( d ) a point on the Cassy Road 92 metres east of its junction with the Cock Hill Road,

( e ) a point on the eastern edge of the Cock Hill Road 138 metres north of its junction with Westbrook Road,

( f ) a point on Westbrook Road 183 metres north-west of its junction with the Cock Hill Road,

( g ) a point on the urban district boundary due west of the seaward end of the Boat Slip approximately 183 metres south-east of Ned's Point

and from the last-mentioned point in a southerly direction along the urban district boundary to the commencement point.

3. The following roads in the Urban District of Bundoran: —

( a ) Bogtown Lane, Rock Road, The Ardfarn or Newtown Road.

( b ) Bay View Terrace Lane for a distance of 374 metres from the urban district boundary.

( c ) The Drumacrin Road between the urban district boundary and a point 210 metres from its junction with the Sligo-Ballyshannon road.

( d ) The road along the urban district boundary connecting the Drumacrin Road with the Ardfarn or Newtown Road.

( e ) The Sligo Road for a distance of 589 metres from the urban district boundary.

( f ) The Ballyshannon Road for a distance of 155 metres from the urban district boundary.

4. The following roads in the Urban District of Letterkenny:—

( a ) The Ballyboe Road, The Leck Road.

( b ) The Glencar Irish Road leading through Ballyboe, Glencar for a distance of 950 metres from the point where the urban district boundary intersects the north-eastern side of the road.

( c ) The road leading in a north-easterly direction from the Glencar Irish Road at a point on the latter road 275 metres north-west of its junction with the Ballyboe Road.

( d ) The Glencar Scotch Road where the said road is a perimeter road.

( e ) The Glencar School Road between the point where the urban district boundary intersects the north-western side of the road and a point 27 metres north-west of its junction with the Glencar Scotch Road.

( f ) The Ballymacool Road for a distance of 91 metres from the urban district boundary.

( g ) The Port Road for a distance of 932 metres from the urban district boundary.

( h ) The Port Quay-Rathmelton road.

( i ) The Rathmelton Road between the urban district boundary and a point 45 metres east of its junction with the Gortlee Road.

( j ) The Gortlee Road between the urban district boundary and a point 109 metres north-east of its junction with the Rathmelton Road.

( k ) The road leading in a north-westerly direction from the Gortlee Road at the urban district boundary.

( l ) The Lismonaghan Road south-eastwards from a point 27 metres south-east of its junction with Oldtown Road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Annagry:—

( a ) The Crolly-Burtonport road between a point 55 metres east of its junction with the Rannamona Road and a point 230 metres west of its junction with the Loughanure Road.

( b ) The Loughanure Road for a distance of 20 metres from its junction with the Crolly-Burtonport road.

( c ) The Rannafast "White Cross" Road for a distance of 20 metres from its junction with the Crolly-Burtonport road.

2. The following roads at Ardara:—

( a ) Ard Connell Cottages Road, Back Street, The Diamond, Front Street, Main Street.

( b ) The Portnoo Road for a distance of 185 metres from its junction with Front Street.

( c ) The Killow Road for a distance of 23 metres from its junction with Back Street.

( d ) The Donegal Road for a distance of 125 metres from its junction with The Diamond.

( e ) The Killybegs Road between its junction with Main Street and a point 75 metres north-east of its junction with Loughros Road.

( f ) The Glenties Road for a distance of 285 metres from its junction with Front Street.

3. The following roads at Ballindrait:—

( a ) The Lifford-Raphoe road between a point 165 metres south-east of its junction with the Castlefin Road and a point 100 metres north of its junction with the Rossgier Road.

( b ) The Castlefin Road for a distance of 280 metres from its junction with the Lifford-Raphoe road.

( c ) The Rossgier Road for a distance of 245 metres from its junction with the Lifford-Raphoe road.

4. The following roads at Ballintra:—

( a ) Fair Green Lane.

( b ) The Sligo-Donegal road between a point 165 metres south-west of its junction with the Rockhill Road and a point 46 metres north of its junction with Church Road.

( c ) The Rossnowlagh Road for a distance of 92 metres from its junction with the Sligo-Donegal road.

( d ) The Rockhill Road for a distance of 92 metres from its junction with the Sligo-Donegal road.

( e ) The Murvagh Road for a distance of 92 metres from its junction with the Sligo-Donegal road.

( f ) Church Road for a distance of 92 metres from its junction with the Sligo-Donegal road.

5. The following roads at Ballyliffin (Magherard): —

( a ) The Clonmany-Carndonagh road between a point 20 metres south of the point where the boundary between the townlands of Ballyliffin and Annagh intersects the road and a point 1,052 metres north-east of the first-mentioned point.

( b ) The Strand Road for a distance of 275 metres from its southern junction with the Clonmany-Carndonagh road and the road connecting this part of the Strand Road with the Clonmany-Carndonagh road.

6. The following roads adjacent to the town of Ballyshannon:—

( a ) The Cluain Bhairrfhinn Road.

( b ) The Station Road for a distance of 147 metres from the point where the boundary of the town of Ballyshannon intersects the south-western side of the road.

( c ) The Donegal Road between the point where the boundary of the town of Ballyshannon intersects the south-eastern side of the road and a point 9 metres south-west of its junction with Coolcholly Lane.

7. The following roads at Bunbeg:—

( a ) Bunbeg Pier Road.

( b ) The Derrybeg-Crolly road between a point 366 metres north of its junction with the Coisclady Road and a point 87 metres south of the said junction.

( c ) The Coisclady Road for a distance of 293 metres from its junction with the Derrybeg-Crolly road.

8. The following roads at Burnfoot:—

( a ) The Station Road.

( b ) The Bridgend-Buncrana road between a point 65 metres south of its junction with the Muff Road and a point 110 metres west of its junction with the Old or Carnashannagh Road.

( c ) The Muff Road for a distance of 138 metres from its junction with the Bridgend-Buncrana road.

( d ) The Brae or Gortnaskee Road for a distance of 92 metres from its junction with the Bridgend-Buncrana road.

( e ) The Old or Carnashannagh Road for a distance of 92 metres from its junction with the Bridgend-Buncrana road.

9. The following roads at Carndonagh:—

All roads in the area enclosed by a line commencing at a point on the Mountain Road 147 metres south of its junction with the Clonmany Road and drawn thence in straight lines successively to the following points:—

( a ) a point on the Clonmany Road 366 metres north-west of its junction with the Mountain Road,

( b ) a point on the Tiernaleague Road 384 metres north of its junction with the Clonmany Road,

( c ) a point on the Malin Road 293 metres north of the junction of Malin Street with Market Place,

( d ) a point on the Moville Road 366 metres east of the junction of Malin Street with Market Place,

( e ) a point on the Ballyloskey Road 183 metres south-east of its junction with the Quigley's Point Road,

( f ) a point on the Quigley's Point Road 275 metres south of its junction with the Ballyloskey Road

and from the last-mentioned point in a straight line to the commencement point on the Mountain Road.

10. The following roads at Carrick:—

( a ) The Bog Road.

( b ) The Killybegs-Glencolumbkille road between a point 37 metres south of its junction with the Ardara Road and a point 334 metres west of its junction with the Teelin Road.

( c ) The Ardara Road for a distance of 55 metres from its junction with the Killybegs-Glencolumbkille road.

( d ) The Teelin Road for a distance of 293 metres from its junction with the Killybegs-Glencolumbkille road.

( e ) Back Lane between its junction with the Killybegs-Glencolumbkille road and a point 183 metres north-east of its junction with the Bog Road.

11. The following roads at Carrickart:—

( a ) Strand Road, Shore Road.

( b ) The Creeslough-Milford road between a point 311 metres south-west of its junction with the Figart Road and a point 119 metres south-east of the said junction.

( c ) The Figart Road for a distance of 160 metres from its junction with the Creeslough-Milford road.

12. The following roads at Carrigans:—

( a ) The St. Johnston-Kildrum road between a point 183 metres south of its junction with the Coxtown Road and a point 526 metres east of the said junction.

( b ) The Coxtown Road for a distance of 110 metres from its junction with the St. Johnston-Kildrum road.

( c ) The Imlick Road for a distance of 215 metres from its junction with the St. Johnston-Kildrum road and the road connecting this part of the Imlick Road with the St. Johnston-Kildrum road.

13. The following roads at Carrowkeel and Quigley's Point (Inishowen Rural District): —

( a ) The Moville-Muff road between a point 138 metres north of its junction with the Cabry Road and a point 211 metres south of its junction with the Carndonagh Road.

( b ) The Cabry Road for a distance of 92 metres from its junction with the Moville-Muff road.

( c ) The Carndonagh Road for a distance of 138 metres from its junction with the Moville-Muff road.

( d ) The Bogstown Road for a distance of 20 metres from its junction with the Moville-Muff road.

14. The following roads at Carrowkeel or Kerrykeel (Milford Rural District):—

( a ) The Rathmullan-Portsalon road between a point 275 metres east of its junction with the Milford Road and a point 320 metres north of the said junction.

( b ) The Milford Road for a distance of 138 metres from its junction with the Rathmullan-Portsalon road.

( c ) The Ranny Road for a distance of 92 metres from its junction with the Rathmullan-Portsalon road.

( d ) The Gortnatraw-Road for a distance of 92 metres from its junction with the Rathmullan-Portsalon road.

15. The following roads at Castlefin:—

( a ) The Long Brae, Main Street, The Diamond, Grahamsland Cottage Roads, New Milford Road.

( b ) The Lifford-Ballybofey road between a point 92 metres south- east of its junction with the Corcullion Road and a point 160 metres west of its junction with the Hillhead Road.

( c ) The Corcullion Road for a distance of 210 metres from its junction with the Lifford-Ballybofey road.

( d ) The Convoy Road for a distance of 138 metres from its junction with the Lifford-Ballybofey road.

( e ) The Hollow Road for a distance of 202 metres from its junction with the Long Brae.

( f ) The Gortnamuck or Ringsend Road for a distance of 65 metres form its junction with the Diamond.

( g ) The Hillhead Road for a distance of 275 metres from its junction with the Lifford-Ballybofey road.

( h ) The road leading from the southern side of the Lifford-Ballybofey road at a point 92 metres west of the junction of the latter road with the Hillhead Road.

16. The following roads at Clonmany:—

( a ) The Buncrana-Clonmany-Straid road between a point 183 metres south-east of its junction with the Ballyliffin Road and a point 138 metres west of its junction with the Binnion Road.

( b ) The Binnion Road for a distance of 92 metres from its junction with the Buncrana-Clonmany-Straid road.

( c ) The Gaddyduff Road for a distance of 183 metres from its junction with the Buncrana-Clonmany-Straid road.

( d ) The Ballyliffin Road for a distance of 138 metres from its junction with the Buncrana-Clonmany-Straid road.

17. The following roads at Convoy:—

( a ) The main Raphoe-Ballybofey road between a point 14 metres south-west of its junction with the Old Raphoe Road between the townlands of Milltown and Convoy Townparks and a point 15 metres north-east of its junction with Augheygault Road.

( b ) The Letterkenny-Castlefinn road between a point 183 metres north of its junction with Main Street and a point 32 metres west of its junction with the Kiltole Road.

( c ) Chapel Road for a distance of 302 metres from its junction with Main Street.

18. The following roads at Creeslough:—

( a ) The Letterkenny-Dunfanaghy road between a point 110 metres south of its junction with the Station Road and a point 110 metres north-west of its junction with the Magheraroarty Road.

( b ) The Station Road for a distance of 92 metres from its junction with the Letterkenny-Dunfanaghy road.

19. The following roads at Culdaff:—

( a ) The Malin-Moville road between a point 183 metres south-west of its junction with the Glengad Road and a point 485 metres south-east of the said junction.

( b ) The Glengad Road for a distance of 64 metres from its junction with the Malin-Moville road.

( c ) The Shore Road for a distance of 183 metres from its westernmost junction with the Culdaff-Gleneely road.

( d ) The Western Shore Road between its junction with the Malin-Moville road and its junction with the Shore Road.

20. The following roads at Derrybeg:—

( a ) The Bloody Foreland-Crolly road between a point 55 metres north of its junction with the Sheskinbeg Road and a point 35 metres north of its junction with the Crolly-Gweedore (Station) road.

( b ) The Sheskinbeg Road for a distance of 46 metres from its junction with the Bloody Foreland-Crolly road.

( c ) The Meenanillar Road for a distance of 138 metres from its junction with the Bloody Foreland-Crolly road.

( d ) The Old Main Road leading to St. Mary's Church at Catheen Bridge.

The Dunfanaghy-Dunglow road between a point 279 metres north-east of the centre-line of Drehidnacally Bridge and a point 60 metres south-west of the said centre line.

30. The following roads at Killybegs:—

( a ) Bridge Street, Catherine's Road, Church Street, Conlin Road, Cottages Road, The Diamond, Fair Green Road, The Hill, Kelly's Quay Road, Main Street, Mulraney's Brae, New Row, Stoneybatter, Water Lane.

( b ) The Roshin Road for a distance of 46 metres from its junction with New Road.

( c ) The Kilcar Road for a distance of 46 metres from its junction with the Roshin Road.

( d ) Conlin Road for a distance of 357 metres from its junction with New Row.

( e ) Church Road for a distance of 915 metres from its junction with Mulraney's Brae.

( f ) The Donegal Road for a distance of 165 metres from its junction with Mulraney's Brae.

31. The following roads at Killygordon:—

( a ) The Lifford-Ballybofey road between a point 252 metres east of its junction with Stoneybatter and a point 183 metres west of the said junction.

( b ) Stoneybatter for a distance of 105 metres from its junction with the Lifford-Ballybofey road.

( c ) Railway Street for a distance of 160 metres from its junction with the Lifford-Ballybofey road.

32. The following roads at Kilmacrenan:—

( a ) Church Road.

( b ) The Milford-Drumbologe road between a point 192 metres north-east of its junction with the Letterkenny-Creeslough road and a point 567 metres south-west of the said junction.

( c ) The Letterkenny-Creeslough road between a point 339 metres south-east of its junction with the Milford-Drumbologe road and a point 183 metres north-west of the said junction.

( d ) The road leading from the north-eastern side of the Letterkenny-Creeslough road at a point 320 metres south-east of the junction of the latter road with the Milford-Drumbologe road.

( e ) The road connecting the Letterkenny Road with the Milford Road at a point on the latter road 128 metres from its junction with the Creeslough Road for a distance of 137 metres from its junction with the said Milford Road.

33. The following roads at Laghey:—

( a ) The Ballyshannon-Donegal road between a point 28 metres north of its junction with the Mullanasole Road and a point 46 metres north-west of its junction with the Old Laghey Road.

( b ) The Old Laghey Road for a distance of 165 metres from its junction with the Ballyshannon-Donegal road.

34. The following roads adjacent to the Urban District of Letterkenny:—

( a ) The Glencar School Road between the point where the boundary of the urban district of Letterkenny intersects the south-eastern side of the road and a point 27 metres north-west of its junction with the Glencar Scotch Road.

( b ) The Kilmacrenan Road for a distance of 165 metres from the point where the boundary of the urban district of Letterkenny intersects the western side of the road.

( c ) The Oldtown-New Mills road between the boundary of the urban district of Letterkenny and a point 28 metres west of its junction with the Rahan Road.

( d ) The Rahan Road between its junction with the Oldtown-New Mills road and a point 138 metres south-west of the said junction.

( e ) The Lismonaghan Road where it is a perimeter road between its junction with the Oldtown-New Mills Road and a point 27 metres south-east of the said junction.

36. The following road at Loughannure:—

The Dunglow-Crolly road between a point 475 metres north-east of its junction with the Meenamara Road and a point 430 metres south-west of the said junction.

( b ) The Carndonagh Road for a distance of 110 metres from its junction with the Culdaff Road.

( c ) The Malin Head or Lagg Road for a distance of 165 metres from its junction with the Carndonagh Road.

( d ) The Glengad Road for a distance of 275 metres from its junction with Millbrook Terrace Road.

( e ) The roads connecting the Glengad Road with the Malin Head or Lagg Road east and west of the Green.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Donegal) Regulations, 1968 ( S.I. No. 73 of 1968 ) and the Road Traffic (Speed Limits) (County of Donegal) (Amendment) Regulations, 1971 (S.l. No. 263 of 1971) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to the subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are exepted from all speed limits by the Regulations.
