ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF MONAGHAN) REGULATIONS, 1977.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1977.

2 Commencement.

2. These Regulations shall come into operation on the 18th day of April, 1977.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. The Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1970 ( S.I. No. 174 of 1970 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following road in the town of Ballybay:—

The Monaghan Road for a distance of 109 metres from the town boundary.

2. The following roads in the Urban District of Carrickmacross:—

(a) The Shercock Road for a distance of 160 metres from the urban district boundary.

(b) The Mullanarry Road for a distance of 379 metres from the urban district boundary.

(c) The Lurgans Road between the urban district boundary and a point 22 metres south-west of its junction with the Mullanarry Road.

3. The following roads in the Urban District of Castleblayney:—

(a) The Monaghan Road for a distance of 128 metres from the urban district boundary.

(b) The Keady Road for a distance of 110 metres from the urban district boundary.

(c) The Shercock Road where the said road is a perimeter road.

4. The following roads in the Urban District of Clones:—

(a) Mullanamoy Lane, Lisnaroe Lane, River Lane.

(b) The Cavan Road for a distance of 505 metres from the urban district boundary.

5. The following roads in the Urban District of Monaghan:—

(a) The Tullyhirm Road, The Old Armagh Road, The Latlorcan Road.

(b) The Clones Road for a distance of 713 metres from the urban district boundary.

(c) The Milltown Road between the point where the urban district boundary intersects the southern side of the road and a point 18 metres north-west of its junction with Rope Walk.

(d) The Castleblayney Road between the urban district boundary and a point 27 metres south-east of its junction with Connolly Park or Pound Hill.

(e) The Coolshannagh Road for a distance of 244 metres from the urban district boundary.

(f) The Emyvale Road for a distance of 841 metres from the urban district boundary.

(g) The Killygowan Road for a distance of 100 metres north of its junction with the Ballybay Road.

(h) The Scotstown Road between the urban district boundary and a point 90 metres west of its junction with the Clones Road.

(i) The Ballybay Road between the urban district boundary and a point 90 metres south-east of its junction with the Cootehill Road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads adjacent to the town of Ballybay:—

(a) O'Duffy Terrace.

(b) The Carrickmacross Road from the boundary of the town of Ballybay to a point 137 metres north-west of its junction with the Creeve Road.

(c) The Castleblayney Road for a distance of 420 metres from the boundary of the town of Ballybay.

(d) The Clones Road for a distance of 190 metres from the boundary of the town of Ballybay.

(e) The Cootehill Road for a distance of 145 metres from its junction with the Carrickmacross Road.

2. The following roads at Bellanode:—

(a) The Monaghan-Scotstown road between a point 75 metres east of its junction with the Lemaculla Road and a point 50 metres west of its junction with the Rosslea Road.

(b) The Rosslea Road for a distance of 80 metres from its junction with the Monaghan-Scotstown road.

(c) The Smithborough Road for a distance of 75 metres from its junction with the Rosslea Road.

(d) The Lemaculla Road between its junction with the Monaghan-Scotstown road and a point 5 metres south of its junction with Carrowhatta Lane.

3. The following roads adjacent to the Urban district of Carrickmacross:—

(a) The Horse Hill Road.

(b) The Magheraboy Road where the said road is a perimeter road.

(c) The Kingscourt Road where the said road is a perimeter road.

(d) The Castleblayney Road for a distance of 310 metres north of the boundary of the urban district of Carrickmacross.

(e) The Ballybay Road for a distance of 137 metres from its junction with the Castleblayney Road.

(f) The Ardee Road for a distance of 250 metres from the point where the boundary of the urban district of Carrickmacross intersects the western side of the road.

(g) The Crossmaglen Road for a distance of 247 metres northeast of the boundary of the urban district of Carrickmacross.

(h) The Dundalk Road for a distance of 20 metres from the boundary of the urban district of Carrickmacross.

4. The following road adjacent to the Urban District of Castleblayney:—

The Connabury Road for a distance of 405 metres from the boundary of the urban district of Castleblayney.

5. The following roads adjacent to the Urban District of Clones:—

(a) The Scotshouse Road for a distance of 475 metres from the boundary of the urban district of Clones.

(b) The Newtownbutler Road for a distance of 140 metres from the boundary of the urban district of Clones.

(c) The Rosslea Road for a distance of 100 metres from the boundary of the urban district of Clones.

6. The following roads at Doohamlet:—

(a) The Ballybay-Castleblayney road between a point 510 metres west of its junction with the Clonaneor Road to a point 90 metres east of the said junction.

(b) The Clonaneor Road for a distance of 40 metres from its junction with the Ballybay-Castleblayney road.

(c) The Rossollus Road for a distance of 45 metres from its junction with the Ballybay-Castleblayeney road.

7. The following roads at Drum:—

(a) The Clones-Cootehill road between a point 455 metres north-west of its junction with the Rockcorry Road and a point 325 metres south-east of the said junction.

(b) The Newbliss Road for a distance of 225 metres from its junction with the Clones-Cootehill road.

(c) The Rockcorry Road for a distance of 155 metres from its junction with the Clones-Cootehill road.

(d) The road connecting the Rockcorry Road with the Newbliss Road.

(e) The Violet Brae Road for a distance of 27 metres from its junction with the Clones-Cootehill road.

8. The following roads at Emyvale:—

(a) The Dublin-Derry road between a point 275 metres south of its junction with the Glaslough Road and a point 247 metres north-west of the junction with the Mullan Road.

(b) The Glaslough Road for a distance of 92 metres from its junction with the Dublin-Derry road.

(c) The Mullan Road for a distance of 70 metres from its junction with the Dublin-Derry road.

(d) The McCready Mills Road for a distance of 70 metres from its junction with the Dublin-Derry road.

(e) Market House Lane Road for a distance of 225 metres from its junction with the Dublin-Derry road.

9. The following roads at Glaslough:—

(a) Main Street, Barrack Road.

(b) The Monaghan-Emyvale road between a point 410 metres south of its junction with Main Street and a point 30 metres west of its junction with the Caledon Road.

(c) The Caledon Road for a distance of 40 metres from its junction with the Monaghan-Emyvale road.

10. The following roads at Inishkeen:—

(a) The Essexford-Louth road between a point 520 metres west of its junction with the Blackstaff Road and a point 300 metres south-east of the said junction.

(b) The Blackstaff Road for a distance of 410 metres from its junction with the Essexford-Louth road.

11. The following road at Lough Egish:—

The Ballybay-Carrickmacross road between a point 30 metres east of its junction with the Castleblayney Road and a point 550 metres south-east of the said junction.

12. The following roads at Newbliss:—

(a) The Monaghan-Drum road between a point 140 metres north-east of its junction with the Ballybay Road and a point 50 metres south-east of its junction with the Hazel Brae Road.

(b) The Killeevan Road for a distance of 145 metres from its junction with the Monaghan-Drum road.

(c) The Ballybay Road for a distance of 45 metres from its junction with the Monaghan-Drum road.

(d) The Scotshouse Road for a distance of 240 metres from its junction with Monaghan-Drum road.

(e) The Hazel Brae Road for a distance of five meters from its junction with the Monaghan-Drum road.

13. The following roads at Rockcorry:—

(a) The Monaghan-Cootehill road between a point 206 metres north-east of its junction with the Newbliss Road and a point 105 metres south-west of its junction with the Ballybay Road.

(b) The Newbliss Road for a distance of 92 metres from its junction with the Monaghan-Cootehill road.

(c) The Ballybay Road for a distance of 92 metres from its junction with the Monaghan-Cootehill road.

(d) The Old Road for a distance of 28 metres from its junction with the Monaghan-Cootehill road.

14. The following roads at Scotshouse:

(a) The Clones-Ballyhaise road between a point 245 metres east of its junction with the Creamery Road and a point 245 metres south of its junction with the Belturbet Road.

(b) The Belturbet Road for a distance of 90 metres from its junction with the Ballyhaise Road.

(c) The Creamery Road for a distance of 220 metres from its junction with Clones-Ballyhause road.

15. The following roads at Scotstown:—

(a) The Monaghan-Knockatallon road between a point 465 metres south-east of its junction with the Tedavnet Road and a point 185 metres north-west of the said junction.

(b) The Tedavnet Road for a distance of 730 metres from its junction with the Monaghan-Knockatallon road.

(c) The Smithborough Road for a distance of 200 metres from its junction with Monaghan-Knockatallon road.

(d) The Gola Road for a distance of 165 metres from its junction with Monaghan-Knockatallon road.

16. The following roads at Smithborough:—

(a) The Monaghan-Clones road between a point 202 metres north-east of its junction with the Rosslea Road and a point 183 metres south-west of the said junction.

(b) The Rosslea Road for a distance of 101 metres from its junction with the Monaghan-Clones road.

17. The following roads at Tedavnet:—

(a) The Monaghan-Clogher road between a point 40 metres south-west of its junction with the Scotstown Road and a point 10 metres north-east of its junction with the Emyvale Road.

(b) The Scotstown Road for a distance of 115 metres from its junction with the Monaghan-Clogher road.

(c) The Emyvale Road for a distance of 80 metres from its junction with the Monaghan-Clogher road.

(d) The Monaghan (Back) Road for a distance of 55 metres from its junction with the Monaghan-Clogher road.

18. The following roads at Three Mile House:—

(a) The Monaghan-Newbliss road between a point 315 metres east of its junction with the Corcaghan Road and a point 275 metres south-west of the said junction.

(b) The Corcaghan Road for a distance of 110 metres from its junction with the Monaghan-Newbliss road.

(c) The Church Road for a distance of 230 metres from its junction with the Monaghan-Newbliss road.

(d) The Drumguill Road for a distance of five metres from its junction with the Church Road.

THIRD SCHEDULE.

Roads in respect of which a special speed limit of 40 m.p.h. is prescribed.

1. The following roads at Annayalla:—

(a) The Monaghan-Castleblayney road between a point 295 metres north-west of its junction with the Cremartin Road and a point 360 metres south-east of the said junction.

(b) The Cremartin Road for a distance of 90 metres from its junction with the Castleblayney-Monaghan road.

(c) The Keady Road for a distance of 65 metres from its junction with the Monaghan-Castleblayney road.

2. The following road adjacent to the town of Ballybay:—

The Carrickmacross Road between a point 137 metres north-west of its junction with the Creeve Road and a point 64 metres south-east of the said junction.

3. The following roads in and adjacent to the Urban District of Carrickmacross:—

(a) The Shercock Road between a point 160 metres east of the boundary of the urban district of Carrickmacross and a point 60 metres north-west of the said boundary.

(b) The Ardee Road between a point 250 metres south-east of the point where the boundary of the urban district of Carrickmacross intersects the western side of the road and a point 600 metres south-east of the first-mentioned point.

(c) The Castleblayney Road between a point 310 metres north of the boundary of the urban district of Carrickmacross and a point 630 metres north of the said boundary.

(d) The Ballybay Road between a point 137 metres north-west of its junction with the Castleblayney Road and a point 685 metres north-west of the said junction.

4. The following roads in and adjacent to the Urban District of Castleblayney:—

(a) The Carrickmacross Road between the boundary of the urban district of Castleblayney and a point 385 metres south of the said boundary.

(b) The Old Ballybay Road for a distance of 75 metres west of its junction with the Shercock Road.

(c) The Shercock Road between its junction with the old Ballybay Road and a point 35 metres north of its junction with the Tattygar Road.

(d) The Monaghan Road between a point 128 metres south-east of the boundary of the urban district of Castleblayney and a point 300 metres north-west of the said boundary.

(e) The Dundalk Road for a distance of 990 metres east of its junction with the Carrickmacross Road.

5. The following roads at Clontibret:—

(a) The Monaghan-Castleblayney road between a point 410 metres north-west of its junction with the Carrickaderry Road and a point 190 metres south-east of its junction with the Keady Road.

(b) The Carrickaderry Road for a distance of 90 metres from its junction with the Monaghan-Castleblayney road.

(c) The Scotchcorner Road for a distance of 5 metres from its junction with the Monaghan-Castleblayney road.

(d) The Keady Road for a distance of 45 metres from its junction with the Monaghan-Castleblayney road.

6. The following roads in and adjacent to the Urban District of Monaghan:—

(a) The Old Armagh Road between its junction with the Castleblayney Road and a point 160 metres south-west of the boundary of the urban district of Monaghan.

(b) The Castleblayney Road between a point 27 metres south-east of its junction with Connolly Park or Pound Hill and a point 230 metres north-west of its junction with Latlorcan Road.

(c) The Ballybay Road between a point 90 metres south-east of its junction with the Cootehill Road and a point 18 metres north-west of the boundary of the urban district of Monaghan.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County of Monaghan) Regulations, 1970 ( S.I. No. 174 of 1970 ) and alter the speed limits applicable to certain roads in County Monaghan.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 m.p.h. prescribed by section 45 of the Road Traffic Act, 1961 , thus enabling a special speed limit of 40 m.p.h. to be applied to some of these roads.

The Regulations declare that the roads mentioned in the Second Schedule, which would otherwise be outside the scope of the built-up area speed limit of 30 m.p.h., shall be subject to that limit.

The Regulations prescribe a speed limit of 40 m.p.h. in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
